2. Heard Mr. Srinivas Bobbili, learned counsel for the petitioner, and the learned Government Pleader for Services-i, appearing for the respondents. Perused the material on record.
3. The petitioner belongs to OC(W) category and completed B.Sc in 1998 and B.Ed in 2003. She applied for the post of SGT under DSC-2008 on 27.12.2008, mentioning her qualifications as B.Sc and B.Ed and not D.Ed. She received Acknowledgement Card No.762/27.12.2008 and Hall Ticket No.23200114944. ln the written test held in May 2009, she secured 63 marks with Rank No.1138. As per G.O.Ms.No.28 dated 29.01.2009, 30o/o of the SGT posts were reserved for D.Ed candidates, which led to the filing of W.P.No.18683/2009, wherein the Court granted interim order on
09.09.2009 suspending the 30o/o rule. On 23.11.2070, the petitioner was informed that she was mistakenly considered as D.Ed candidate and was not entltled for appointment, as the last OC(W) candidate appointed under the 7 Oo/o list had secured 64.5 marks. In November 2 n 2010, the respondents filled SGT vacancies, leaving 1800 posts unfilled. Subsequently, on 08.02.2024, the Court passed interim order in W.P.No.18683/2009 directing that B.Ed candidates be considered for appointment on a contract basis. On 26.09.2024, the petitioner clarified her qualifications and was' asked to submit a representation due to a typographical error. Despite submission of the representation on 26.09.2024 to respondent No.2 and also another representation dated 26.O9.2024 to respondent No.4, no action was taken. On 14.02.2025, under G.O.Ms.No.14, the respondents appointed B.Ed candidates with Ranks 1140, 1141, LI49, 7158, 1164, and 1166, but denied appointment to the petitioner, who had secured Rank No.1138. Aggrieved by the same, the petitioner filed the present Writ Petition.
4. Learned counsel for the petitioner submits that appropriate orders be passed in this Writ Petition, directing the respondents to consider the representation submitted by the petitioner on
26.09.2024 and pass appropriate orders in accordance with the law.
5. Learned Government Pleader for Services-I, appearing for the respondents, did not dispute the submissions made by the learned counsel for the petitioner.
6. Taking into consideration the submissions made by the learned counsel for the respective parties, without going into the / I 3 merits of the case, this Writ Petition is disposed of directing respondent Nos.2 to 4 to consider the petitioner's representation dated 26.09.2024, and pass appropriate orders in accordance with the law, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a..copy of this order. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed. / To, //TRUE COPY// SD/-P.
