CHALLA KIRANMAYEE Counsel for the Respondents: AGP FOR REVENUE The Courtlmade the following: ORDER ORDER: THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.14211 of 2025 This writ petition is hled seeking following relief: "lt is therefore prayed that this Hontrle Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent in not taking action pursuant to Application vide 250O0O4601 hled for mutation in respect of land admeasuring Ac. O.22OO guntas in Sy.No's. 559/5 situated at Chirmiryala village, Kodada Mandal, Suryapet District and may be pleased to pass such other Order/s as this Hon'ble Court may deem ht and proper in the facts and circumstances of the case."

It is stated that petitioners' father late Sri Mudra Venkeshwar Rao was the absolute owner and possessor of agricultural land admeasuring Acs. 0.2200 guntas in Survey No.559/5, situated at Chirmiryala Village, Kodada Mandal, Suryapet District (for short, 'the subject land'). It is further stated that the petitioners' father along with his mother and his minor brother obtained a decree dated 01.O3.1952 in O.S.No.61/1 of 1951 seeking declaration oI right of assignment of lands mentioned in Schedule A, B and C against the elder brother Mudra Nageshwar Rao and thereafter the petitioners' father obtained declaration from the Land Reforms Tribunal, Huzurnagar in C.C.No.5733 dated 27.O9.1976 declaring the total extent of land belongs to late Sri Mudra Venkateshwar Rao and his family members and tili today, the lands mentioned in the declaration dated 27.09.1976 are in the name of the petitioners' father and his family members. It is further stated that the petitioners' father died on 14 .O4.2025 and petitioners' mother also died on O1.O1.2O22 leaving behind the petitioners are legal heirs. It.is I I 2 CVBR, J W.P.No.14211 of 2025 further stated that the revenue records continued to reflect the name of the petitioners' father as pattadar and possessor of the subject land and pattadar passbook was also issued to the petitioner uide Passbook No.T2909O111937 and Katha No.9582. T}.e grievance of tl-re petitioners is that they made an application bearing No.2500004601 for mutating therr names in the revenue records, but till date the same was not considered by the respondent authorities. Hence, the present writ petition.

3. Considered the submissions of the learned counsel for the petitioner and learned Assistant Government Pleader appearing for the respondents and with their consent, this writ petition is being disposed of at the admission stage.

Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that Telangana Rights in Land and Pattadar Passbooks Act, 2O2O (for short "the Act 9 of 2O2O") has been repealed and replaced with Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short, 'the Act 1 of 2O25'l ar'd if the petitioners submit online application in the prescribed format in Bhu Bharati Web Portal and if the same fulhlls all the requirements of the Act 1 of 2025 ar-d the Rules made thereunder, the respondent authorities will consider the same, in accordance with law.

In view of the above submission, this Court deems it appropriate to dispose of this writ petition permitting the petitioners to CVBR, J W.P.No.14211 of 2O25 make appropriate online application in the prescribed format in Bhu Bharati Web Portal, seeking mutation of their names in the revenue records and for issuance of pattadar passbooks in respect df subject land. In the event of such application being made by the petitioners and if the same fullrlls all the requirements under the provisions of tie Act 1 of 2025 ard the Rules made thereunder, the respondent authorities sha1l examine and consider the case of the petitioners. In any event, if the application of the petitioners does not fulfill the requirements of the Act I of 2025 and the Rules made thereunder, the respondent authorities shall pass a reasoned order, in accordalce with law and communicate the same to the petitioners. The entire exercise shall be completed within a period of three (03) months from the date of receipt of the application.

6. With the above obiervations, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications pending, if any, shall stand closed. //TRUE COPY// SD/. P.
