Petition under Article 226 of rhe constitution of rndia praying that in the circumstances stated in the affidavit filed therewith, the High court may be pleased to issue an appropriate writ, order, or Direction. more particularly one in the nature of a writ of Mandamus declaring the action of the Respondents in not filling the clear vacancies that have arisen pursuant to Notifications No. .1 , 2, 3, and 9 of 2023, all dated 05.04.2023, issued by the 4th Respondent, on account of candidates who, after being appointed to lower cadre posts such as Trained Graduate Teachers (TGT) and Post Graduate Teachers (pGT), subsequenfly relinquished the said posts upon joining higher cadre posts like Degree college Lecturers (DL) and Junior College Lecturers (JL), as arbitrary, illegal, and violative of Articles 14, 16, and 21 of the constitution of lndia and contrary to the principles laid down by the Hon'ble supreme court in lvlunja praveen and others v. state of relangana and others, (2017) 14 scc 797 and consequenfly direct the Respondents to fill up the said clear resultant vacancies by considering eligible candidates from the provisional selection list or merit list, and to consider the candidature of the Petitioner for such resultant vacancies if they fall within the zone of consideration with all consequential benefits. lA NO: 1 OF 2025 Petition under section 15'l cpc praying that in the circumstances stated in the affidavit filed in support of the petition, the High court may be preased to t direct the Respondents to forthwith identify and disclose the clear vacancies that have arisen pursuant to Notifications No. 1 ' 2' 3, and 9 of 2023, all dated 05.O4.2O23, on account of relinquishment of lower cadre posts such as TGT and pGT by candidates who have subsequently joined higher cadre posts such as JL and DL, and to consider the case of the Petitioners and other eligible candidates against such clear resultant vacancies by operating the merit list downwards, in accordance with the law laid down by the Honble Supreme Court in tvlunja Praveen and Others v. State of Telangana and Others, (2017) 14 SCC 797, and the interim orders passed by this Honble Court in W.P. No. 7161 of 2024 ' W 'P' No. 19335 of 2024 and w.P. No. 26030 of 2024, and pass such other order or orders as may be deemed fit and proper in the interest of justice' pending disposal of the above writ petition. Counsel for the Petitioner: M/s.
