2. The pe-:itioner is a resident of Church C)ompound, Suryapet, Nzrlgonda, within respondent No.1 Municipality. According to the petitioner, respondent Nos.2 and 3 are making const.ruction without obtaining building permission. Therefore, she has submitted a representation dated
06.ll.2014 to respondent No.1 with a request to take action against respondent Nos.2 and 3. Thereafter, respondent No.1 has issued building permit order dated 25.11.2024 to respondent ltlos.2 and 3 for construction of residential building with stilt + four upper floors. Even then, respondent Nos.2 and 3 zre making construction in deviation to the said ') building permit order. Therefore, the petitioner filed the present writ petition.
3. Vide order dated L4.tO.2Ol5, this Court directed respondent No.l to ensure that no further construction activity takes place over the house bearing Nos. 1-7-179/D1 and 1-7-179 /D5, Khammam Road, Suryapet, Nalgonda District, until further orders.
4. Learned Standing Counsel for respondent No.1, on instructions, r,r,.ould submit that respondent Nos.2 and 3 are proceeding with the construction.
5. Learned counsel for respondent Nos.2 and 3, on instructions, would submit that the said building permit order was expired in the year 2017 aod they have approached respondent No.1 for extension of time for construction. Therefore, they will not proceed with the construction.
6. In the light of the said submissions, this Writ Petition is disposed of, gralting liberty to respondent Nos.2 and 3 to pursue with respondent No.1 seeking extension of time to complete the construction pursuant to the said building I I I I I l i I I t -1 permit order dated 25.11.2014 or to obtain fresh building permit order or work commencement letter from respondent No.1 and thereafter, proceed with the construction. If there is any deviation, liberty is granted to respondent No.l to take action against respondent Nos.2 and 3, strictly in accordance with the procedure laid down under the Telangana Municipalities Act, 2019. In the circumstances of the case, there shall be no order as to costs.
