Purushotham. … Petitioner This Court made the following: THE HON'BLE SRI JUSTICE SANJAY KUMAR COMPANY PETITION No.238 of 2011 ORDER: This company petition was presented by M/s. Greenko Godavari Power Projects Private Limited through its Director, Sri C.Purushotham, seeking sanction of a scheme for merger and amalgamation between itself and its shareholders on the one hand and M/s. LVS Power Private Limited and its shareholders on the other hand. It is now stated by way of an affidavit by Sri Puroshotham, the Director of the petitioner company, that as consent was not received from the ICICI Bank, the secured creditor of the transferee company, it was resolved to withdraw the company petition with liberty to represent the scheme for sanction either in its present form or in a modified form at any future point of time.
