Vffrfdb SfruCH Counsel for the Respondents: AGp FOR STAMPS AND REGISTRATION The Court made the foilowing: ORDER THE HONOURABLE SRI JUSTICE K.SARATH WRIT PEf,ITION No.13944 of 2o25 ORDER: Heard learned counsel for the petitioner and learned Assistant Government Pleader for Stamps and Registration appearing for the respondents and perused the material on record. With their consent, this writ petition is disposed of at the stage of admission.

Aggrieved by the action of the respondent No.2 herein in orally refusing to receive and register the Sale Deed dated 23.04.2025 in respect of plot bearing No.76 in Sy.Nos. 155 and 156, admeasuring 253.33 square yards, situated at Gopanpally Village, under Serilingarnpaliy Mandal, Ranga Reddy District on the ground that there is status-quo order passed by this Court in W.A.Nos.310 and 311 of 2022, dated 29.04.2022 and with reference to the letter dated O3.O3.2O25 issued by the respondent No.3 ade Lr.No.B/1342/2025, the petitioner filed the present writ petrtlon. .,1 o w.P.No.1re44 q25;! 3. Learned Assistant Cor"h*rt pleader for Stamps ald Registration submits that without presenting the document, the petitioner has approached this Court seeking registration of the document. If the petitioner presents the same before the Registering authorit5r, the respondents will receive the same and follow the procedure as contemplated under Section T7 of the Registration Act, 1908 (for short, .the Act, 19Og). 4 The Section 71,of the Act, 190g, reads as follows: Reasons for refusal Lo register to be recorded._ (1) Every Sub-Registrar refusing to register a documcnt, except on the ground that the property to which it relates is not situated within his sub_ district shall make an order of refusal and recorded his reasons for such order in his Book No.2, and endorse the words "registration refused, on the document; and, on application made by any person executing or claiming under the document, shall, without payment and unnecessary delay, give him a copy of the reasons so recorded. (2) No registering officer shall accept for registration a document so endorsed unless and until, under the provrstons hereinafter contained, the document is directed to be registered. 3 sr, J W.P.No.73944 oJ 2025

In view of the above made submissions coupled with the provision under Section 71 of the Act, 190g, this writ petition is disposed of directing the Registering Authorier to receive, register and release the subject document, subject to the petitioner complying with thel provisions of the Act, 1908 as well as the Indian Stamp Act, 1g99. It will be open to the Registering Authority to refuse the document presented before him, if. he has any objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject document registered. There shall be no order as to costs.
