VENUGOPAL SIRIT PEIITION No.2OO92 OF 2O2& OR ER: This Writ Petition is liled under Article 226 of Constitution of India seeking the following relief/s:- "... to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2"d respondent herein in not taking action on the representation dated 27.04.2021 submitted by the petitioners herein requesting to implementation of final decree proceedings issued in IA No.57 of 2010 in OS.No.S0 of 2OO6 on the frle of the Court of the Principal Junior Civil Judge, Vikarabad, by issuing E-Pattadar Pass Books in the name of the petitioners in respect of the land admeasuring Ac.0.32 guntas in Sy No.156/10 and Ac.O.25 guntas in Sy No. 161/5, situated at Nagsanpally Village, Kotpally Mandal, Vikarabad District is being illegal, arbitrary, unreasonable and violative of aricle 14 and 3OOA of the constitution of India and violation of the principles of nahrral justice and contrary to the provisions contemplated under the records of rights Pattadar Pass Book Act and rules made there under and consequently direct the respondents herein to consider ttre representation dated 27.O4-2O21 submitted by the petitioner herein by issuing the E pattadar pass books and pass such other order or orders ..."

2. Heard Mr.Koppula Gopal, learned counsel for the petitioners and Mr.H.Rakesh Kumar, learned Assistant Government Pleader representing learned Government Pleader for Revenue appearing for respondents.

The brief facts of the case are that petitioner No.l is the second wife of one Late Sangaiah; that Sangaiah married one Suvarna and they were blessed with three children during their wedlock; that after the death of Suvarna he married petitioner No.l for tJ:e second time; that Late Sangaiah was the absolute ./V owner and possessor of the lands admeasuring Ac 1.2O guntas in I 1 2 survey N,r.156/10, Ac.1.O9 guntas in survey No.L6ll5, situated at Nagsa:rpally Village, Kotpally Mandal, Vikarabad District; that after the demise of Sangaiah all the properties were in the narne of E.Krishnaveni, elder daughter of his late lirst wife; that the petitione::s filed suit vide O.S.No.SO of 2006 on the file of the learned.lunior Civil Judge, at Vikarabad against the daughters of the first wife of Late Sangaiah; that the suit was preliminarily decreed on 17.12.20O9 and Iinal decree proceedings were also issued by virtue of final decree dated O2.Ol.2Ol4 in I.A.No.57 of 2O1O irr O.S.No.SO of 20O6; that after the final decree proceedings, petitioner No.l had ; approached the respondents seeking to mutate their names in the rev€nue records. But in vain; thart petitioner No.1 has also'made an on-line application in Dharani portal for issuance of E-patteoar pass books. But no action vras taken by respondents; that the representation dated

27.04.2021 made by the petitioners before respondent No.2 is pending consideration. Aggrieved by the same the petitioners filed the present Writ Petition.

4. [rarned counsel for the petitioners submits that represe:ntation dated 27.O4.2O21 made before respondent No.2 is f-, 3 under consideration till date. Therefore, he seeks indulgence of this Court, to pass appropriate ord.ers.

5. karned Assistant Government Pleader for Revenue submits that the representation dated 27.o4.2o2t is filed long back. Therefore he seeks a direction to the petitioners to file a fresh representation before respondent No.4 seeking to mutate their names in the revenue records and the same would be considered in a short span of time.

6. Having regard to the submissions of both the learned counsel and on perysal of the material available on record, this court is inclined to ;direct the petitioners to lile a fresh , ,. representation before respor.rdent No.4 within a period of four (4) weeks from the date of receipt of a copy of this order. On filing such representation, respondent No.4 is directed to examine the sarne and pass appropriatg orders, as per law, as expeditiously as possible, preferably within a period of six (6) months thereon.
