RAKESH REDDY, A(i ) FOR REVENUE (TG) The Court made the following: ORDER THE HON'BLE SRI JUSTICE E.V.VENUGOPAL 1VRIT PETITION No.2O14O OF 2022 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief/s:- "... to issue a Wnt, Order or direction, more partlcularly, a Writ in the nature of Mandamus, declaring the action of the Respondents, more particularly Respondent Nos-3 & 4 in not including the lands held by the Petitioner in the new e Pass Book, i.e. land admeasuring Ac. O O9 Gts., in Sy. No.332/2, totally admeasuring Ac. O 15 Gts., of Janwada Village, Shankarpa-lly Mandal, R.R. District, as illegal, arbitrarv, unreasonable and violative of Article 14 & 300 A of the Constitution of India consequently direct the Respondents 3 & 4 to include the lands held by the Petitioner in the new e- Pass Book, i.e land admeasuring Ac. 0-09 Gts., in Sy.No.332 and land admeasuring Ac. 0 O6 Gts., in Sy. No. 333/2, totally admeasuring Ac. O-15 Gts., of Janwada Vrllage, Shankarpa-lly Mandal, R.R. District and pass such other suitable order or orders ..."

2. Heard Mr.Ravinder Reddy, learned counsel representing Mr.Ch.Venkateshwara Reddy, learned counsel for the petitioner and Mr.H.Rakesh Reddy, learned Assistant Government Pleader for Revenue appearing for respondents

3. The brief facts of the case are that the petitioner had purchased the land admeasuring Ac.0-09 Gts. in Sy.No.332 and Ac.0-O6 Gts. in Sy.No.333/2 in Janwada Village, Shankarpally Mandal, R.R. District under a sale deed bearing 2 Document No.5705/ 7997, dated 26.08.1997 Iic m one Lingam Anthaiah; that it was not mentioned in the sz le deed about the extent of land purchased in each survey nr I :rber, as such, the same w:rs rectified under a Rectificatior Deed bearing Document No.72852 l2OO4 Dated 2O.12.2Ot) 1; that after purchasing the land, the 4th Respondent vide l, oceedings No. B', l5A22l2OO1 sanctioned mutation in r ame of the Petitioncr: that the petitioner was given the 1tle Deed and Patt:rdar Book bearing Patta No.927 for the ,ubject iands; that the. narne of the Petitioner was also I hown in the Pahanies for the 2003-2004; that the Petition :r was issued nerv e-Patta Pass Book rvith Pass Book No.l'r y524OO9O271; that in the said neu' e -Pass Book the lands ea lier shown in the O1d Book i.e., in Sy.No.332, admeasuring; Ac.O 09 Gts., and in Sy.No.333/2, admeasuring Ac.O-06 ( ts. were not shown; that the Petitioner submits that she is. in possession of the land and cuitivating the same but the .l h Respondent for undisclosed reasons did not properly me.t ,ion the total extent of land held by the Petitioner; that the .1 h Respondent after sanction of mutation proceedings issued )attadar pass Book and Title Deed as per the old Act. F{ rwever, while ! j t i I I I i t I I I I : I i I I I 3 I I { I I I I i I l I I i I i I I I I ) l I I I issuing the new e-Pass Book under the new provisions the entire extent of land held by the Petitioner was not included; that the Petitioner made a Dharani Application in Land matter through Mee-Seva with Application No LM2100007929 dated 03.O7.2021 for correction in the e-Pass Book by including the ieft out lands i.e., land in Sy.No.332 admeasuring Ac.0-O9 Gts., land admeasuring Ac.O-O6 Gts., in \ \ Sy.No.333/2, totally admeasuring Ac.0-15 Gts., of Janwada Village, Shankarpally Mandal, R.R. District and till date no response is forthcoming from Respondents 3 & 4. Aggrieved by the same, the petitioner preferred the present Writ Petition

4. Learned counsel for the petitioner seeks indulgence of this Court to direct respondent No.4 to process the Dharani Application dated 03.07.2021, submitted by the petitioner applied in Mee-Seva vide application No.LM210OOO7929 and pass appropriate orders.

5. Learned Assistant Government Pleader for Revenue submits that the plea of the petitioner would be considered by respondent Nos.3 and 4 in a short span of time and seeks to dismiss the Writ Petition. 4
