BHASKAR REDDY UIRIT PETITION No.13 765 of 2025 ORDER: This writ petition is fi1ed seeking to declare the action of the respondents in not processing petitioners application No.2400125455 for issuance of e-pattadar passbook in respect of agricultural land to an extent of Ac'S'12 gts'' in Sy.No. 145/42/2, situated at Suddanpally Village, Dichpally Mandal, Nizamabad District, as illegal, arbitrary and for other appropriate reliefs.
2. Considered the submissions made by the learned counsel for the parties and with their consent, this writ petition is being disposed of at the admission stage.
3. possessor of the land admeasuring Ac'5' 12 It is stated that the petitioner is the pattadar and gts., 1n Sy.No. 145/42l2, situated at Suddanpally Village, Dichpally Mandal, Nizamabad District, having purchased the same through a registered sale deed bearing No.6331 of 2006, dated I
12.05.2006. It is further stated that the name of the petitioner was mutated in all the revenue records and pattadar passbook has also been issued in his favour under the provisions of tl.e Telangana Rights in Land and Pattadar Passbooks Act, 1971 2 CVBR, J wp 13765 2025 and the Rules made thereunder (for short "the Act, 1971'). It is further stated that when e-pattadar passbook was not issued to the petitioner under the provisions of the felangana Rights in Land and Pattadar Passbooks Act, 2020 (for short "the Act 9 of 2020\, he made an online application uid"e No.24OO125455, dated 27.77.2024 seeking for issuance of e-pattadar passbook in respect of the subject property. The grievance of the petitioner is that even after receipt of the said application, the respondents did not consider the same. Hence, the writ petition.
4. Sri L. Ravinder, learned Assistant Government Pleader for Revenue, has not disputed the issuance of pattadar passbook in favour of the petitioner under the Act, 1977 and also the submission of the application made by the petitioner. He further submitted that the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O (for short "the Act 9 of 2O2O"l has been repealed and replaced with Teiangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short "the Act 1 of 2025") and if the petitioner submits online application in the prescribed format in Bhu Bharati Web Portal and if the same fulfills all the requirements of the Act I of 2O25 and the Rules made rz-- =- ---=;ry=r l I II , 3 CVBR, J Wp 13765_2025 thereunder, the respondent authorities will consider the same, in accordance with law. In view of the above submissions, this Court deems it
5. appropriate to dispose of the writ petition permitting the petitioner to make a fresh application under the provisions of the Bhu Bharati Act and the Rules made thereunder seeking for issuance of pattadar passbook in respect of the subject property. In the event of such application being submitted by the petitioner and if the petitioner complies with all the requirements under the provisions of the Act 1 of 2025 and the Rules made thereunder, the respondents shall examine and consider the case ol the petitioner. In any event, if the petitioner has not satislied with the requirements of the provisions of the Act 1 of 2025 and the Rules made thereunder, the respondents shall pass a reasoned order, in accordance with law and communicate the same to the petitioner. The entire exercise shall be completed within a period of three (O3) months from the date of receipt of a copy of this order'
6. With the above observations, this Writ Petition is disposed of.
