Petitioner claims to be lawful owner of the Plot No.638 admeasuring 200 square yards in Survey No.56 situated at Narapally Village, Pocharam Municipality, Medchal-Malkajgiri District, having purchased the same by registered sale deed bearing document No.4 I 73 of 1 987 dated 27 .05.1987. Petitioner had been in possession and enj oyment of the subject property. It is submitted that vendors of the petitioner namely Mr. G. Mysaiah and others were assigned the land admeasuring Acs.36-00 guntas in Survey Nos.56 and 58 of Narapally Village. The names of the 2 - vendor of Jre petitioner was mutated in revenue re cords as pattadars. 'lhey have executed registered General I'ower of Attorney in favour of Mr. Haji Ati and others vlde r locument No.32l87-B-IV dated 30.01.1987 and converted the land into residential layout by obtaining permission lrom the c oncemed authorities. Accordingly, the subject plot was purchast d by the petitioner in I 987

3.2 [t is submitted that as the Govemment u,as claiming the land in Survey Nos.56 and 58 as their land, petitioner tnd other owners individually submitted applications unc er G.O. Ms.No.166 <lated 16.02.2008 for regularization of the plc,ts which were in their possession. During the pendency of the regularization applications, lttempts were being madc by rcspondent ar rthorities to dispossesr; the pctitioner and others from their plots, as such, they filed W.P. No.19471 of 2009, through registered sr ciety by name, Sri Raghavendra Nagar Housing Society. wherei'r, status quo order rvrr:; passed by this Court on 23.09.2009. 3.3 It is submitted that while matter stood thus, on

24.04.2025, without issuing any prior notice and without following due process of law, respondent Nos.2 to 4 attempted to take measurements of the subject property for laying road through the plot of the petitioner in Surwey Nos'56 and 58. Petitioner and other 30-40 plot owners were getting affected in the proposed road, and objected the said road, and informed the respondent authorities that they are absolute owners of the property having purchased the same under registered sale deeds and their applications for regularization under G.O. Ms.No.166 dated 16'O2'2008 are pending. However, respondent authorities insisted the petitioner to vacate the subject property, or else he would be dispossessed from the subject property. Having no other alternative, petitioner was constrained to approach this Court.
