FORTGS PDCL The Court made the following: ORDER THE HON'BLE SRI JUSTICE NAGESH BHEEMAPAKA WRIT PETITION No.13322 OF 2Q.25 ORDER: The present Writ Petition has been filed seeking to declare the action of the respondent authorities (respondents No.2 to 6) in threatening to disconnect the electricit5r power supply to the petitioner's property bearing Municipal No.3-5- 1099, FIat No.304, Grace Fatima KGN Apartments, Narayanaguda, Hyderabad, despite the subsistence of an injunction order dated L4.O7.2022 in O.S. No. 329 of 2022 on the hle of the X Additior,:rl Chief Judge, Ciry Civil Court, Hyderabad, as illegal, arbitrary and violative of Articles 14 and 2I ol the Constitution of India, and consequently to direct the respondents not to disconnect or dismanfle the electricity supply to the said premises.

Learned counsel for the petitioner submits that the petitioner is the lawlul owner and possessor of the subject property, having I I ! , I :i l I I I l I I I I ! t I L I i I l I I I i I I 2 duly obtained an electricit5r connection and hzl' ing regularly paid all dues pertaining thereto. He submits that (he petitioner is protected by an injunction order in his pending s uit i.e. O.S.No.329 of 2022 for specific performance, yet responder t authorities have threatened disconnection at the behest of thi: d parties without proper notice or due process. He further subm.1 s that such action of the respondent authorities is arbitrary and r iolative of Articles 14 and 21 of the Constitution of India, as we [I as principles of natural justice.

Accordingly, the power supply was restored immediately, and the respondent authorities have undertaken not to -isconnect the sarne so lor,1 as the petitioner continues to reside therein and there are no due s pending towards electricity cons umption.

In view of the categorical statement made ty the respondent authorities that power supply has already bee r restored to the 3 subject property of the petitioner and that no disconnection would be effected excgpt in accordance with law, nothing further sunrives for adjudication in this Writ Petition.
6. Accordingly, the Writ Petition is closed, recording the statem€nt of the respondent authorities. It is, however, made clear that the respondent authorities shall not disconnect or dismantle the electricity supply to the subject property of the petitioner except in accordance with law and after following due process.
