Justice Tirumara Deui Eada) This appeal, under Section 54 of the Land Acquisition Act, L894, (f<rr short 'the Act) is preferred by the special Deputy Collector, LA Unit, SRSP, LMD Colony, Karimnagar, aggrieved by the order- and decree dated 2z.or.2oo4 passed in o.p.N o.67 of 1996 by the learned Senior civil Judge at Huzurabad (hereinafter referred tc as 'the Reference Court).
2. For convenience and clarit5r, the parties herein are referred to as they wsre arrayed before the Reference Court.
3. The facts of the case in brief are that based on the requisitio, made by the Executive Engineer, I & D Division No.2, Huzurabad, the land admeasuring Ac.10-03 guntas situated at chelpur, Madipali villages of Huzurabad and Jammikunta Mandals was acquired by the Government, for the purpose of excavatiorL of canal. The draft notilication under Section 4(1) of the Act was prrblished in the Gazette on 25.01.19g9. After conducting due enqui:ry, the Land Acquisition officer (LAo) has fixed the varue of the lanct of Red cherka soil @Rs.T,600/- per acre and for brack 2 AKS,J & ETD,J LAAS No.455_2007 chelka soil @ Rs.1O,30O/- per acre in Chelpur village and LAO has also fixed the market value of the Black Chelka Soil in Madipalli village @ Rs.9,0OO/- per acre. Aggrieved by the said award, the claimants have filed a petition for reference and the same was referred under Section 18 of the Act to the Court of Senior Civil Judge at Huzurabad

The case of the claimants is that their lands are very fertile lanCs and are suitable for both agricultural and house sites and their lands fetch a value of more than Rs.1,SC,OOOl- per acre, but the LAO has fixed a very low amount of Rs.7,6OO/- per acre to Red Chelka soil and.Rs.1O,30O/- per acre for black chelka soil in Chelpur village and he has fixed Rs.9,O00/- per acre to Black Chelka soil in Madipalti village. 'lhe lands of both the villages were acquired in the proceedings and the compensation awarded by the LAO is very low.
5. Based on the above pleadings, the Reference Court has framed the following point for consideration: "Whether the compensation awarded by the LAO to the claimants can be enhanced as prayed for? [f so to what relieP"
6. At the time of trial, the claimants got examined PWs 1 to 4 and got marked Exs.Al to A4. On behalf of the respondent, RW1 was examined and Exs.R1 and R2 were marked. / / ./ a\ - 3 AKS,J & ETD,J LAAS No.455_2007

Bas;ed on the evidence on record, the reference court has awarded a compensation of Rs.30,000/- per acre in respect of Black soi.i lands and Rs.34,ooo/- per acre in respect of Red soil lands, ap,lrt from awarding statutory benefits. Aggrieved by the said order, the Special Deputy collector , LA Unit, sRSp, LMD Colony, Karimnagar, has preferred the present appeal.
8. Hea::d the submissions of learned Government pleader for the appellant and sri Tangeda Dayananda Rao, learned counsel for the respondents.
9. The learned appellant counsel has submitted that the reference ,lourt has enhanced the compensation without there being any basis. He further argued that the claimants failed to prove thal. their lands fetch higher value than that of the compensat.on awarded by the LAo but in the absence of any proof, the reference court has enhanced -the compensation to Rs.3o,00o/- per acre in respect of Black soil lands and Rs.34,00o /- per acre in respect of Red soil lands, therefore, he prayed to st:t aside the same.
10. The r-'spondents counsel, on the other hand, has submitted that the cla,.mants have filed the sale deeds disclosing a higher rate of sale prict: i.e. around Rs.4o,0o0/- per acre. He further argued 4 AKS,J & ETD,J LAAS No.455-2007 that the value of the acquired land is much rnlore than .Rs.1,50,000/- per acre, while the LAO has awarded a meager compensation, the reference court has enhanced the same to Rs.34,0ool-peracrewhichisactuallyverylowbuthowever,the claimants have not preferred any appeal, he therefore prayed to uphold the said orders of the reference court and prayed to dismiss the aPPeal.
11. Based on the above rival submissions, this court [rames the following points for consideration: Whether the compensation awarded by the reference Court is just and reasonable? Whether the order and decree of the reference Court need anY interference? To what relief.2 1 2 3 L2. POINT NO.l: a)Insupportofthecontentionoftheclaimants,PWsland4 were examined. Pw4 is the vendee in the sale deed under Ex'A1 dated 30.07. Lg84. In his evidence it is elicited that actually the worth of the land, is Rs.1,5O,0OOl- per acre but to avoid the stamp drty,theyhaveshownthemarketvalueasRs'40'0O0/-peracre' However, their evidence was found to be wavering during the cross examination, thus, the reference court has not relied upon their / / (- 5 AKS,J & ETD,J LAAS No.455 2007 evidence. Further, the lands in Ex.A1 fall in a village Dharmaram and the present acquisition is in chelpur and Madipalli village and there is no evidence of the claimants to show the distance of the acquired land and the land sold under Ex.Al. Though, they say that they are adjacent, no proof is filed before the Court. Thus, Ex.Al was discarded by the reference Court. b) Thr: land covered under Ex.A2, another sale deed pertains to Madipalli village and is meant for house sites, it is situated in survey N,r.532-A of Madipally village and as per the award under Exs.Rl and R2, the lands in present acquisition do not fall in survey Nc.532A and the claimants failed to show the proximity between l.he survey No.532A and the lands acquired in the present proceedings and they also failed to produce any evidence to show that their lands are suitable to house sites. Thus, Ex.A2 was also not consirlered by the reference Court. c) A perusal of the award under Ex.Rl shows that the LAo has not produced the sales statistics before the Court, however, it is observed that he has taken the sales statistics into consideration and passt:d the award. As per the award, it shows that the land in chelpur village is a well developed area than that of the Madipally village anc the land in chelpur village that is acquired is abutting the PWD .:oad. Thus, the lands in chelpur village must have been \r qr \ I I :i 6 AKS,J & ETD,J LAAS No.455_2007 awarded higher value. According to the award, the red Chelka soil of Chelpur village was fixed. at Rs.7,6OOl- per acre' while the rate of Black soil at Madipatly village was fixed at Rs.9,OOO l- Per acre. d) Thus, the LAO failed to produce the sales statistics considered by him before the Court and there is also a discrepancy found between the observation made and the award passed by him. It was observed by the LAO that the lands in Chelpur village are well developed and are abutting PWD road, then he could have awarded more amount to the said lands, while he hds awarded more amounts to the lands in Madipally village, thus, the LAO award is found to be not justified' e) The claimants have further relied upon Exs.A3 and A4 which are the order and decree in OP No.63 of. 1996, which pertain to the acquisition proceedings in a different village. The claimants could not produce evidence to show that the thnd acquired under Exs'A3 and A4 are adjacent to the present acquired land and the amount that was enhanced under the said OP is Rs.75,O0O /- per acre. The land acquired in the said OP pertain to Madipalli village and are situated in sy.Nos.360, 36I, 382 and 384. PW2 is a party to the land acquired under Exs.A3 and A4 and he is the 4ft claimant herein and according to him, the lands covered under Exs.A3 and 44 and the lands acquired are just adjacent to each other but he I / \ \ 7 AKS,J & ETD,J LAAS No.455_2007 has not deposed in his evidence about the particulars of the land acquired in o.P.No.63 of 1996. As per Exs.A3 and. A4, the land in survey rrumbers 360, 361, 392 and 3g4 was acquired and no evidence is produced by the craimants to show that the said survey numbers fall adjacent to the present acquisition. 0 By observing the entire evidence on record and taking all the factors i,to consideration, the reference court has opined that there should be a just and reasonable compensation to be awarded to the clirimants and it cannot be too high as deposed by the claimants under Exs.Al and A2 while it cannot be as low as the amount awarded by the LAo, therefore, it has awarded Rs.3o,0o0 I - per acre in respect of black soil lands and Rs.3 4,ooo I _ per acre in respect of red soil lands, apart from awarding the statutory benefits. Thus, the reference court has culled out valid reasons for enhancing the compensation, therefore, it is held to be just and *:asopable. point No.1 is answered accordingly.
13. POIITT NO.2: In view of the reasoned finding arrived at point No.l, this court holds ih"t th" order and decree of the reference court do not need any irrterference.
