The Court made the following: ORDER -7 THE HONOURABLE SRI JUSTICE N.TUKARAMJI l.A.Nos. 2 and 3 0F 2025 ln/And CRIMINA L PETITION No.5908 OF 2025 COMMON ORDER This Criminal Petition is filed under Section 528 o'f Bharatiya Nagarik Suraksha Sanhita, 2023 (Ior short 'BNSS' 2023') seeking quashment of the proceedings against the petitioner in SC'No'362 of 2019 on the file of lhe Metropolitan Sessions Judge at Nampally' of 2018 on the file of PS SR Hyderabad and Crime No'690 Nagar,HYderabad District.

2. The petitioner is accused in SC'No'362 o'f 2019 registered for the offences punishable under Sections 326(b), 354(D) of the lndian Penal Code,'1860.

3. Heard Mr.G.Santosh Pawan Babu' learned counsel for the petitioner, Mr.Jithender Rao Veeramalla' learned Additional Public Prosecutor, representing the respondent No'1-State and Ms'V Krishna Veni, learned counsel for the respondent No 2/de-facfo complainant'

Pending this petition, the parties have entered into the compromise and, accordingly, respondent No'2/de-facto complainant filed l'A'Nos'2 and 3 of 2025 with the prayer to permit them to enter into compromise 2 N,nrJ I.,l.h,t.t.2 and ) oJ 202 5 in/ and (.r/. P.N0.5 908 ol2025 and by recording the settlement to quash the proceedings against the petitioner/accused in SC.No.362 of 2019

5. This Court vide otd daled 24.06.2025 referred the parties to the High Court Legal Services Committee for identification and to verify the voluntariness in arriving the settlement. The Secretary, High Court Legal Services Committee, has submitted report dated 08.07.2025 stating that the parties were identified by their respective counsel and also on verification of Aadhar Cards/ldentity Cards and the enquiries revealed that the parties have willfully and without coercion entered into settlemenUcompromise.

6. I have considered the submissions of the learned counsel and perused the materials on record.

Having considered the allegations, the nature of charged offences and taking into account the amicable settlement between the parties and to restore peace between the parties, in the light of the dictums in Gian Singh v. Stafe of Punjab and anotherl and Anil Mishra v. State of lJ.P.2; State of Madhya Pradesh v. Laxmi Narayan and others3, this Court is of the considered view that quashment of the impugned | 2012 (1o) scc 303 'z zo24 INSC 189 3 2019 (s) scc 688 3 t\rTR,rr 1..,1.N0i.2 a lttJ 202i it/and Lrl.P.No.;908 tJ 202i proceedingsinviewofthesettlementbyexercisingjurisdictionunder Section4S2Cr.P.C.|S2BofBNSS,2023,wouldbeintheinterestof justice.
