2. Learned counsel for the petitioners submitted that petitioner Nos. I and 2 are the co-owners ol- the commercial building bearing premises No.8-2-293182lJ-Il1l573H &.573-I in Plot Nos573H & 573-1, in total admeasuring 1282 square yards, situated at Road No.1, Jubitee lrlills, I{yderabad. Petitioner No'3 is l-he owner of commercial building bearing premises No.S-2-686/5/5641568 in Plot Nos.56A & B admeasuring 1022.22 sq. yards, situated at Road No.12, Agrasen Chowk, Banjara Hills, Hyderabad"the Govemment has proposed to acquire several properties in Jubilee Hills and Banjara Hilts, Hyderabad, for widening of road' The building of petitioner Nos.l and 2 to an extent of 463.44 square yards (3,384 1 \ 2 square feet) and the building of petitioner No.3 to an extent of
208.22 sq. yards are being affected in the proposed road widening from existing width to 100-00" feet from Virinchi Hospital to Agrasen Junction, Banjara Hills, and to 120-00' feet from the Agrasen Junction, Banjara Hills, to the Jubilee Hills Check Post via KBR Park. The petitioners have not given consent for acquisition of their property. Several buildings in Banjara Hills and Jubilee Hills of Flyderabad will be affected in the road widening and it will create huge loss to the property owners who have constructed buildings for their personal occupation or commercial use. Respondents are I intending to acquire the portion of the potitioners without following due process of law and without resorting to the provisions under Sections 146 and 147 of the Greater Hyderabad Municipal Corporation Act 1955 (for short'Act 1955') and the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'Act 2013')
3. Learned counsel for the petitioners stated that in similar circumstances, the order dated 28.02.2025 was passed by this Court in W.P. No.5977 of 2025, in favour of the petitioners therein and prayed to grant similar relief in favour of the petitioners herein. J
4. I-eamed standing counsel for GI{MC submitted that the subject propefiy of the petitioners will bc acquired in accordance with the provisions of the Act 1955, more particularly, Section i47 ( I ol the Act 1955.
5. ln view ol the aforesaid submissions of the learLred standing counsel for GHMC, the writ petition is disposed of' granting tiberty to the petitioners to submit representations to respondent No.l I - the Municipal Courmissioner, GHMC, with a request to drop the proposal of the road widening' On receipt of the samc, respondent No.ll shall consider the representatio.ns, and pass orders' in accordance with law, by aflbrding opportunity of hcaring to the petitioners, within a period ol'four (4) weeks lrour the tlate of receipt ofa copy of this order. If respondent No.lt is not inclined to accept the request made by the petitioners, he shall assign specific reasons, pass an order, and communicate the same to the petitioners. Further, if respondent No.l l is not inclined to accept the request made by the petitioners, respondent Nos.
