Learned counsel for the petitioner contended that the Tribunal ought not to have granted the interim direction since the first respondent is not in the feeder category and that the writ petitioner is not made a party to the O.A.

It is for the Tribunal to decide the O.A. on merits and in accordance with law. However, having regard to the averments in the writ affidavit, we direct the official respondents to consider the case of the petitioner herein as well as the first respondent for further promotion, as per law.
