I.A.N :1 OF 2025 Petition Under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 2 to 4 and 6 to execule and implement the LOC issued against the 5th respondent vide Originator Ref. No. 23ID4-LOC/CCRB/RKD/2023 dt. 1611212023 in connection with Crime No. 531 of 2023 under Section 420, 406 lpc on the file of P.S.Chaitanyapuri, Rachakonda pending disposal of the writ petition. VINOD KUMAR Writ Petition No.13113 of 2025 ORDER: Heard learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 to 4, and with the consent of the learned counsel appearing for the parties, the Writ petition is taken up for hearing and disposal at the admission stage.
2. Having regard to the manner of disposal of the Writ Petition at the admission stage and the nature of /s involved, this Couft is of the view that notice to unofficial respondent Nos.s and 6 is not necessary for adjudication of the present Writ Petition.
3. The petitioner by the present Writ Petition is questioning the inaction on the part oF the respondents-authorities in reopening the Look- out Circular (LoC) issued against the 5th respondent in connection with Crime No.531 of 2023 in spite of the 5s respondent violating the conditions imposed by the Court below while suspending the LoC, which action of the authorities it is contended as lllegal, arbitrary and contrary to law.

Per contra, learned Government Pleader for Home appearing on behalf of respondent Nos.l to 4 would submit that whether there is vrolation or not of the condition imposed while suspending the LoC, is to L I 2_ -_ -,i be adjudicated only by the concerned Court and for the said purpose, the petitioner is requlred to approach the concerned Magistrate/Court, which has granted interim protection to the Srh respondent herein and for the said purpose, the petitioner cannot maintain the present Writ petition. 5' Learned Government preader wourd further submit that in simirar circumstances, the petitioner in w.p.No.3002 r of 2024 was granted riberty to file an appropriate application before the trial Court to reopen the LoC issued, if there is any violation of conditions imposed by the concerned Court.

Learned Government pleader further submits that since, the petitioner in the present Writ petiuon has made similar prayer, the petitioner herein shourd arso be directed to approach the concerned court by bringing to the notice of the concerned Court of the violation of the condition imposed for the Court to take a decision as to revoke LoC.

I have taken note of the respective contentions urged. 8' Having regard to the submissions made as above, since, it is the concerned Magistrate who had granted relaxation of LoC in favour of the 5th respondent herein, if there is any vioration of the conditions imposed by the concerned Magistrate, while granting such relaxation, the petitioner is required to approach the concerned Magistrate bringing to the notice the a'eged vioration of the condition of the order passed by the concerned 3 Magistrate and seek For revocation of the suspension of LoC and for the said reason, cannot maintain the present Writ Petition.
9. Since, it is now stated to this Court of the petitioner approaching the concerned Magistrate, thls Court is of the view that the petitioner is directed to pursue the remedy before the concerned Magistrate.
10. Granting liberty as noted hereinabove, the Writ Petition is disposed of. No order as to costs.
