Additional Public Prosecutor on behalf of the Respondent No.1 and of Sri John Sigmani Joseph, Advocate for the Respondents No.2 & 3. The Court made the following: COMMON ORDER THE HON'BLE SMT. JUSTICE TIRUMALA DEVIEADA l.A.Nos.2 and 3 of 2025 in/a nd CRIMINAL PETITION No.5800 ot 2025 COMMON ORDER: 1. This Criminal Petition is filed under Section 528 of BNSS, 2023 seeking to quash the proceedings against the petitioners/accused Nos.1 & 2 in P.R.C.No.25 o'f 2024, on the file of the learned Principal Junior Civil Judge-cum-Metropolitan Magistrate, Medchal-Malkajgiri District, functioning from Kushaiguda, registered for the offences under Sections 448 and 307 of lPC.
2. lt is submitted by learned counsel for the petitioners/accused Nos.1 & 2 as well as respondent Nos.2 & 3 that during pendency of the Criminal Petition, the parties have compromised the matter and accordingly, LA.Nos.2 and 3 of 2025 have been filed seeking permission to enter into compromise and to record compromise between them
3. The learned Additional Public Prosecutor has opposed the compromise petitions
4. Perused the affidavits filed by the de facfo complainant in l.A.Nos.2 & 3 of 2025 which discloses that the respondent Nos.2 & 3 2 have willingly consented for compromise. Since ttre parties were willing to enter into compromise, they were given a c;hance to setile the matter by appearing along with their respectivr: counsel before the High Court Legal Services Committee for the State of Telangana vlde orders dated 08.09.2025 passed by this Court The Secretary, High Court Legal Services Committee shall identify, :he parties and submit a report to that effect.
5. Pursuant to the above said direction issued by this Court, the parties along with their respective counsel have app _-ared before the High Court Legal Services Committee for the State of Telangana and the Secretary of the above said Authority identified the parties and submitted a report dated 16.09.2025 stating that trr: parties were identified and they have willfully, without any coercicn, entered into compromise.
6. ln view of the above, LA.Nos.2 and 3 of 202.3 are allowed, Consequently, the Criminal Petition is allowed and ihe proceedings in P.R.C.No.25 of 2024, on the file of the learned principal Junior Civil Judge-cum-Metropolitan Magistrate, Medchal-M alkajgiri District, functioning from Kushaiguda, registered against the petitioners/accused Nos.'l & 2, are hereby quashec :;ubject to the petitioners paying an amount of Rs.5,000/- (Rupees Five Thousand \ 3 Only) to the Telangana High Court Bar Association, Hyderabad and Rs.5,000/- (Rupees Five Thousand Only) to the High Court Legal Services Committee for the State of Telangana, Hyderabad, within a period of two (02) weeks from today and file proof of the same before the Registry. 7 Miscellaneous applications, if any pending, shall stand closed.
