RAKESH KUMAR, AGP FOR REVENUE The Court made the following: ORDER THE HON'BLE SRI JUSTICE N.V.SHRAVAN KUMAR Writ Petition No.32801 of 2016 ORDER: The petitioner is aggrieved by the action of respondents in attempting to evict the petitioner backyard and courtyard in H.No.l 37 /1 from the area of 20OO sq.yds., in Sy.No.210 of Chandanagar Vlllage, Serilingampall,y Mandal, Ranga Reddy District without following due process of laq,.
2. The petitioner submits that petitioner's father is in possession of Ac.2 37 gts., in Sy.No.21O and the said land is a Government land. Earlier petitioner had carried out wet cultivation u,ith the help of water leaking from Manjeera water pipes passing through adjoining 1ands. The land revenue in the name of Shivai Jamabandi was collected from the petitioner lrom 1983. Thereafter, the land was converted into house-site pattas rn the year 2Ol4- 15 and accordingly petitioner constructed 4 tin sheds lor cattle and for living. These structures were given H.No. 1- 37 I A and the propertv tax was also being collected and that 1U -to 15 house site pattas have been granted to the 2 \r-I poor people in the said Survey number. Thereafter, G.O.Ms.No.59 dated 30.12.2O14 came into force and petitioner applied lor regularization for he said 2000 sq.yds., or. 27.O2.2015 along u,ith Rs.50,O{)0,/- DD before MRO, Sherilingampally, Ranga Reddy District. The said applicatior-r is pending for consideration. (tuestioning the same, the present writ petition is filed.

In uietu of the aboue, if the petitioner is tn possessjon as on todag, he sholl not be rllspossessed without follouLing due process of lau- Post after tuo weeks."
4. Learned counsel for the petitioner submits that even after passing of the said interim order, the application of the petitioner is still pending for consideration and no counter affidavit has becn filed by respondents.
5. Mr.H.Rakesl-r I(umar, learned Assistant Government Pleader for Revenue appearing on behalf of respondents submits that the said G.O.Ms.No.59 dated
30.12.2014 is kept in abeyance and a decision is yet to be taken on the said G.O.Ms.No.59

In vieu, of the submission made by the learned counsel on either side, this s,rit petition is disposed of directing the respondent authorities to adhere to the order passed by this Court on 30. 1 I .20 16 till the petitioner's application for regularization is decided or till the G.O.Ms.No.S9 dated 30.12.2014 is given effect to. Till then, the petitioner shall not be dispossessed. .1 --
