It is quile evrdent from t.he rccord that erren Mekala VenkaLeshu,arlu sustained rnjuries in the accident, as revealed from the charge sheel. This substantiates the occurrence of acciclent and thc contents of the charge shcet lurther reveal that it occurrccl onl1, due to the rash and negligencc of Maroju Venkatershwarlu. d) The tribunal has held that lhe cleceased r,r,as also negligcnt. [t gave a finding to that effect by observing that the deceased .,.vas not holding a valid driving license as on the date of the arcciclctrt and erlso was not wcaring any helmct as requircd under the Motor Vehicles Act and thus, the deceased committed breach of. manclatory provisions of Motor Vehicles Act. Thcrefore, attributing contributory. ncgligencc to [he deceased, tribur-ral has fixed the liability as 50% each on the owners and insurers of both the motor bikes. 'l'o prove contributory negligence, an act of the person contributing [o the accident should be made out.
