Judgment
Heard both sides. The petitioner/judgement debtor filed this Civil Revision Petition under Section 115 C.P.C., inter alia, assailing the order dated
18.12.2006 passed by the Principal Junior Civil Judge, Gurzala in allowing E.P.No.22 of 2005 in O.S.No.138 of 1998. This Court, on 23.02.2007, while admitting the revision petition granted interim stay subject to condition of the petitioner depositing half of the decretal amount. In that view of the matter, and having regard to the finding of fact recorded by the Court below that though the petitioner was having sufficient means to pay the E.P amount, he was avoiding to pay the same, I am not inclined to interfere with the impugned order. The Civil Revision Petition is accordingly dismissed. However, the petitioner is permitted to deposit the balance decretal amount, within a period of three months from the date of receipt of a copy of this order, in default, the interim order shall stand cancelled. There shall
