ORDER: THE HON'BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No. 1 1933 of 20.25 This Writ Petition is filed by the mother of the deceased employee of the respondent Company, seeking to declare the action of respondent Nos.l to 3, in.ot paying the 1/4th sha-re of compensation Amount, as illegal, arbitrarv, unconstitutional and violative of principles of natural justice, and consequently, to direct respondent Nos.1 to 3 to pay the 1/4tn share of compensation Amount to the petitioner herein.

2. Heard Dr- Challa Srinivas Reddy, learned counsel appearing for the petitioner; Sri C. Raman Kumar Reddy, learned Additional Standing counsel for Singareni collieries company Limited, on behalf of respondent Nos.l to 3; and Sri Gurram Srinivas, learned counsel appearing on behalf of respondent No.6.

Learned counsel for the petitioner submits that while the petitioner's son was working as a scavenger with the respondent company, he had passed away on 26.05.2022 in harness, and thus, the respondent company assured the payment of Rs.30,00 ,ooo /_ to the petitioner, her daughter-in-law and grand children (wife and children of the deceased) in equal shares. Horvever, respondent Nos.1 to 3, while I / \ 2 prepared to pay the compensation amount to the petitioner's daughter- in-law (respondent No.6), they are ignoring the petitioner herein, which is highly illegal, arbitrary, unconstitutional and violative of principles of natural justice. Therefore, learned counsel seeks indulgence of this court to direct respond.ent Nos.1 to 3 to pay the I /+n share of Compensation Amount to the petitioner.

Per contra, learned Standing Counsel for respondent Nos.1 to 3, submits that the respondent company had proposed the payment of compensation Amount of Rs.3o,0o,o0o/- to the family members of the deceased Safai Karmachari, and only his wife, i.e., respondent No.6 herein, was orally informed to submit a copy of her bank passbook for taking further necessary action, which has not been submitted so far. As such, the payment of said compensation amount is pending. However, there is no liability or promise on behalf of the respond.ent Company with regard to the payment of Corhpensation Amount to the petitioner herein. As such, it is prayed to dismiss the present writ petition.

Learned counsel for respondent No.6 filed counter affrdavit stating that the matter is discussed outside the Court and respondent No.6 has no objection with regard to payment of I /+tt share of the Compensation t: 3 Amount of Rs.30,0O,0OO/- to the petitioner. paragraph No.g of the counter aJfidavit reads as under: "It is submitted tlwt, tuithout going tnto the merits and" ci.emerits of the case, uithaut going into rules and regulations and eligibility criteria of the petitioner and respondent No.6, and uithout going into ang other i.ssues, and due to dire need of moneg, and to set e tLrc i.ssue amicable, the respondent No.6, decided to settle the issue in a peaceful ,rtanner and uoluntarilg agreed to giue r/a sltare (one slnre, out of 4 sllores) to the petitioner i.e., mother-in-law of tlrc respondent No.6 (moth.er of the deceased emplogee late Sri Tagoor Sunit/ Late husband of the respondent No.6). Having regard to the submissions advanced by learned counsel for the respective parties and in view of the specihc no-objection expressed by respondent No.6 herein, this writ petition is disposed of directing respondent Nos. 1 to 3 to pay the I /4rh share of compensation Amount of Rs.3O,O0,0O0/ - to the petitioner, as also the remainin C a /4h share to respondent No.6 herein, as expeditiouslv as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order.
