Learned Assistant Government Pleader fo.L' Stamps and Registration submits that without pres;enting the dor:urlent, t..re petitioner has approactred this Court o SI(, J w 12911_2A25 seeking registration of the document. If the petitioner presents the same before the Registering authority, the respondents will receive the same and foliow the procedure as contemplated under Section 71 of the Registration Act, 1908 (for short, 'the Act, 1908').

The Section 71 of the Act, 1908, reads as follows: Reasons for refusal to register to be recorded.- (1) Every Sub-Registrar refusing to register a documenl, except on the ground that the property to which it relates is not situated within his sub- district shall makc an order of refusal and recorded his reasons for such order in his Book No.2, and endorse the words "registration refused,, on the document; and, on application made by any person executing or claiming under the document, shall, without payment and unnecessary delay, give him a copy of the reasons so recorded. (2) No registering officer shall accept for registration a document so endorsed unless and until, under the provisions hereinafter contained, the document is directed to be registered.

In view of the above made submissions coupled with the provision under Section 71 of the Act, 1908, this writ i I v / SK, J v P 12911,2025 petition is disposed of directing the Registr:ring Authority to receive, r'egirjl-er ald release the subject docume:et, subject to the pc:titir>ner complying with the provisions ,rf the Act, 19OB as n,ell as the Indian Stamp Act, 1899. It uill be open to the Registering Authority to refusr: thr: document presente<l b,:lore him, if he has any otljectiorr , by duly assigninp; r()asons in support of such decr.sion and communicatr: the said decision to the peti._ioner. It is made clear th at thrs Court has not expressed any c,pinion on merits of the case as to the entitlement of the pertitioner to get the s,ubject document registered.
