JUSTICE SUREPALLI NANDA WRIT PETITION No.10394 OF 2018 ORDER: Heard Sri M.Durga Prasad,. .learned counsel appearing on behalf of the petitioner, learned Assistant Government Pleader for Energy appearing on behalf of respondent No.1 and Sri N.Sreedhar Reddy, learned Standing Counsel for TGSPDCL, appearing on behalf of the respondent Nos.2 to 4. 2 The oetitioner aooroache the Court seekinq oraver as under: "...to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 3 and 4 in not receiving the application for grant of new electric service connection to the peutioner's Plot bearing No.245 in Sy.No.l1l8, tt/g, 7t/tO, t1l11 and 7l/Parl admeasuring 4U sq. yards situated at Khanammet Village, Rajendra nagar Taluk, R.R. District as illegal and arbitrary and contrary to the Provisions of A.p.Electricity Act and consequently direct the respondents 3 and 4 to receive the application of the petitioner for grant of new electric service connection forthwith in respect of plot bearing No.245 in Sy.No.11/8, t1./9, ltltO, 11/11 and t7/Part admeasuring 417 sg. yards situated at Khanammet '?.\ 2 SN,] wp 10394 2018 Village, Rajendra nagar Taluk, R.R. District and to pass such other order or orders may deem fit and proper in the circumstances of the case. "

The case of the petitioner. in brief, is that the petitioner is the absolute owner and possessor of the plot bearing No.245 admeasuring 477 Sq. yards situated in Sy.Nos.1l/8, Ll/g, 1l/10, 11l11 and L 1/Part situated at Khanammet Village, Rajendra Nagar Taluk, Ranga Reddy District. Despite being the rightful owner and being in possession of the subject plot, respondents 3 and 4 have refused to provide an electricity connection/ citing a ban on connections for plots in the Ayyappa Society Colony. The petitioner approached the respondent authorities on several occasions, but they've orally refused to receive the petitioner's application for a new electric service connection. Aggrieved by the same, the petitioner filed the present writ petition"

Petitioner souqht interim relief in the present writ petition as gnder: "...to direct the respondents 3 and 4 to receive the application of the petitioner for grant of new electric service connection forthwith in respect of Plot bearing No.245 in Sy.No.11/8, 11/9, lI/IO, 11/11 and ll/Part admeasuring 417 sq. yards situated at Khanammet Village, Rajendra r 3 SN,] wp 10394_2018 nagar Taluk, R.R.District, pending disposal of the above writ petition and Pass... " This Cou rt. ide its order dated 29.O3. 2018 in I.A.No.1 of 2018, oa ed interim orders in favour of the Detitio ner observlnq as u der: "It is brought to the notice of this Court that, in identical set of circumstances, this Court passed an interim order, dated 18.12.2015, in W.P.No.32614 of 2015. In view of the same, there shall be interim direction as prayed for. " PERUSED THE RECORD.

The Counter aff idavit has been filed on behalf of the resDo ndent No.4 and in oart cular, oara raoh No.3 of the said counter is extracted hereunder: "It is submitted that on verification regarding any service connection in the above referred premises it is found that the Petitioner has already been provided with a service connection bearing No. 12001 07965 in premises bearing 3-245 Ayyappa Society, Khanammet Village, Serilinga mpally. As the petitioner is already having a service connection, I 4 SN,] wp 10394_20 18 T another service connection in the name of the petitioner cannot be provided. As per General Terms and Conditions of Supply only one service connection can be provided to a dwelling house."

Learned Standing Counsel for TGSpDCL, appearing on behalf of the respondent Nos.2 to 4 placing reliance on the averments made in the counter affidavit filed on behalf of the respondent No.4 in particular paragraph No.3 ( referred to and extracted above), submits that the petitioner had already been provided with a service connection bearing No.12001 07965 in premises bearing No.3-245 Ayyappa Society, Khanammet Village, Serilingampally and therefore. another service connection in the name of the petitioner cannot be provided since as per the General Terms and Conditions of Supply. Only one service connection can be provided to a dwelling house.

7. Learned Standing Counsel further submits that the interim orders of this Court dated 29.03.2018 passed in I.A.No.1 of 2018 had become infructuous since the petitioner had already obtained Service connection.
