MURALIDHAR REDDY The Court made the following: ORDER ( I I THE HOI{'BLE SRJ WSTICE E.V.VENUGOPAL WRIT PETITION lto.14o48 of 2O2O ORDER: The present writ petition is filed by the petitioner under Article 2'b of the Constitution of India seeking issuance of a writ of Court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of ttre respondent No.4 in non issuance e-pattadar pass book to the petitioner's land in Sy.No.44 to an extent of Ac.0.05 gts., Sy.No.45 to an extent of Ac.O.37 gts., Sy.No.48/A to an extent of Ac.O.O4 gts., Sy.No. I05/ 1 to an extent of Ac.2.2O gts., Sy.No.168 to an extent of Ac.0.32 gts., Sy. No. 169 to an extent of Ac.0.29 gts., and Sy.No. 176 to an extent of Ac.O.3O gts., total land to an extent of Ac.5.37 gts., situated at Pedda Golconda Revenue Village Siver, Shamshabad Mandal, Ranga Reddy District as highly illegal, arbitrary, unconstitutional, violation ol principles of natural justice and also in violation of Articles 14. 19 (1) (g) and 21 and 30O-A of the Constitution of India and consequently direct the respondent No.4 to issuance e-pattadar pass book to the petitioner's land.
2. Heard Sri Dinesh Reddy, Iearned counsel representing Sri Ropolu Bhaskar, learned counsel for the petitioner and Sri Hingolekar Rakesh Kumar, learned Assistant Government Pleader appearing on behalf of Govemment Pleader for Revenue Sri K.Muralidhar Reddy.
3. The learned counsel for the petitioner submits that the petitioner is the pattadar and cultivator of the subject land. The land, originally measuring Ac.7.00 gts., in Sy.Nos.44, 45, 48, 1O5 and 168 was acquired by the petitioner's late father, whose name was duly mutated in the revenue records and to whom pattadar passbooks were I issued. He cultivated ttre land during his lifetime. After his demise, the property was partitioned among the petitioner and his brothers viz.Rukma Reddy, Chandra Reddy and Mohan Reddy. The revenue authorities accordingly mutated the said extent in the petitioner's name and issued a Pattadar Passbook bearing No.192275 and Patta No.25 in the year 1995. The petitioner has since been in peaceful and uninterrupted cultivation of the said lands. Subsequently, the Government of Telangana launched the Land Records Purihcation Programme along with the ffihu Bandhu Scheme, under which e- Pattadar Passboohs were to be issued. In this context, revenue officials visited the petitioner's village, conducted a Grama Sobha and issued a Samachara Prathi for corrections. The petitioner duly submitted the corrected Samachara Prathi along with the team leader's receipt, requesting issuance of the e-Pattadar passbook. However, upon the petitioner's relusal to comply with certain unoffrcial demands bv the ( / I l Page 3 of4 revenue authorities, they developed grudge and deliberately withheld issuance of the'e-Pattadar Passbook. Despite making representations to Respondent Nos.2 and 3 seeking redressal, no action has been taken till date. The State Government has mandated issuance of e-Pattadar Passbooks to all eligible farmers and Respondents 2 to 4 are statutorily bound to implement the same. In the absence of any alternative remedy and in view of continued inaction, tJ:e petitioner is constrained to approach this Court by way of the present writ petition.

On the otJrer hand, learned Assistant Government Pleader, representing leamed Government Pleader for Revenue submits that issuance of e-Pattad"ar Passbook is subject to verification of land ownership ald compliance with the prescribed procedures under the Telangana Land Revenue Act and related government guidelines. The allegations of unollicial demands or personal vendetta are baseless, unsubstantiated, ard intended to mislead the Hon'ble. There is no inaction or arbitrariness on part of the respondents. Thc learned Assistant Government Pleader seeks a direction to the petitioner to file a fresh application before the respondent No.4 Tahasildar to verify and cause enquiry and to take appropriate action in accordance with law.

Having heard the rival contentions advanced on either side and upon perusal of the record, this Court deems it appropriate to \ \ grant iiberty to the petitioner to file an appropriate application before \ the 4th respondent along with the supporting documents to demonstrate his claim within 4 weeks from the date of receipt of copy of this order and upon receipt of the same, the 4th respondent shall dispose of the same in accordance with law and the procedure contemplated and pass appropriate orders as expeditiously as possible preferably within six months thereon.

Having heard the learned counsel on both sides and upon perusal of the record, this Court deems it appropriate to dispose of the present writ petition by granting liberty to the petitioner to lile an appropriate application before respondent No.4, along with supporting documents to substantiate his claim, within 15 days from the date of receipt of a copy of this order. Upon such filing, respondent No.4 shall examine the application in accordance witJl law and the applicable procedure and pass appropriate orders as expeditiously as possible, preferably within a period of six months thereafter.
