The petitioner-defendant No.2 filed this revision under Article 227 of the Constitution of India, inter alia, seeking to assail the order dated 18.04.2007 passed in O.S.No.82 of 2004 on the file of the X Additional Chief Judge, City Civil Court, Hyderabad, in rejecting the petition in regard to marking of suit document on the ground of want of stamp duty and registration. Having heard the learned counsel on either side and on perusal of the material available on record, I am of the view that since the suit is for specific performance, where trial has commenced, it is appropriate for the Court below to consider this objection at the time of final disposal of the suit. Hence, the petitioner has to be allowed to mark the document subject to objection, which can be gone into at the time of final disposal of the suit.
