The Court made the following: ORDER I I Orde r, hcH n'b le Sri t1 e .Sreeniv s Rao C e o N .5279 of 202 This Cr-rminal pedtion is filed by the pedtioner/accused No.1 seeking anriciparory bail ,nder Sectio n 4g2 or the Bharatiyr Nagarik Suralsha Sanhita (for shon ,BNSS), connecrion with Cnme No.231 of ZOZ+ on the file of Sration House Officer, Chaderghat police Station, Hyderabad, regrstered for the offen6es punishable under Sections 302, 142, 148, 120-8, 109 read q/ith 149 of the Indian penal C_ocle, 1g60 (IPQ and Section 25(1BxA) of the Indian Arms Act, 1959. 2. The briel' facts of the case are rhar on 29.a6.2024 ar about 01:54 hours, the Inspecror of police, Chaderghat police Station, received a complaint from the complainant to the effect that on 2g.06.2024 ar around 13:30 houn, his father wenr our along with his friend Syed Ali Flabeeb Jafri and did not retum till late rught and when his morher called him over phone, he said that he would come after having dinner and ,-1 2 Iater on 29.06.2024 at about 01:54 houn, his cousin called him and informed that his father was brutally killed with kn.ifes at Malalpet Metro Station, Chaderghat, Hlderabad. He expressed his suspicion over the accused as eight dap prior to the incident, his father informed him that he had financial dispute with accused No.3 in the aforesaid cr-ime and he was threatened wrth dre consequences. Basing on the said complaint, the aforesaid crime was registered against the accused

Heard Mr. Katika Ravinder Reddy, Ieamed counsel for the petitioner/accrxed No.l and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent/State. 4 Leamed counsel for the petitioner submimed that the petitioner/accused No.1 has not committed any offence as alleged agairut him and in fact, at the time of the alleged incident, he was residing in Dubai by virtue of his employment and initially, his name was not mentioned in the FI& but 3 subsequently, based on the confession made by other accused, his name wa^s arrayed as accused. He further submitted that the entire allegations are levelled against acctued No.12. who is the main culpnt, and the only allegation levelled against the petitioner is that he took amount from accused Nos.12 and 1l for implementing the plan of murder of the deceased,, He further subrnitted that the investigating officer, after conducting investigation, filed the charge sheet and the same was numbered as PRCNo.425 of 2024 on the file of VIII Additional C.hief Metropolitan Magistrate, Hl.derabad, and accused No.12 in the aforesaid crime was already granted anticipatory bal. uide order dated 28.08.2024 in Gl.P.No.9727 of 2024. He further submits that earlier, the petitioner approached this C-ourt by fiirng Crl.P.No.2076 of 2025 for grant of anticipatory bail, but the said application was dismissed on 27.02.2025 on the ground that custodial interrogation is required. He further submits thar even according to the-+rosecution, charge sheet has already been 4 filed and cutodial interrogation of the petitioner is no more required and praF ro grant anticipatory bail ro rhe petitioner/accused No.1 as he is readyand willing ro cooperate with the investigation and abide by the conditions that may be imposed bythis C-ourt.

Per conrra, Ieamed Additionai Public Prosecuror opposed the bail petition stating that the petitioner/accused No.1 has comrnitted grave offence and specific allegarions are levelled againsr him that he received an amount of i Rs.10 lakhs from accused Nos.12 and 13 for implemenring the plan of murder of the deceased and distributed the said amount to the other accused and committed the offence. He funher submitted that the.,.earlier bail applicarion riq., G1.P.No.2076 of 2025 was rightlydismissed bythis Coun by giving cogent reasons and there are no changed circurnstances to file the present bail application and the petitioner is not entitled for grant of anticipatorybail.
