The petitioners have fiIed Crl'MP Nos'683 to 751 of 2021 beforc the trial Court under Section 451 read with Section 457 of Cr.P.C., seeking interim custody of cash of Rs' 1'7O'OO0/-' Rs.1,60,OOO/-, Rs.1,4O,OOO/-, Rs'1,2O,00O/-, Rs'1'1O'O0O/-' Rs. 1,12,500/-, Rs.i,07,5OO/- and Rs'1,OO,O0O/- pending disposal of main case mainly contending that upon the inducement mpde Page 2 of5 by the accr.Ls: I on the pretext that they would provi(le d ruble bed room flats i1 - Bahadurpally Village from the Gover rment of Telangana, ttr ) ", have paid the above said amounts to thr: accused however, 1 av Lng received the same, the ac(:useC g ave fake ailotment L.l.lr r and cheated not only the petitioners bu also the innocent putr. i,:. A13 grieved by the said findings of the trizrl Court, the present cri, rir rLl petition is filed mainly conte:ndi:rg hat the petitioners; iLre [1e victims in the hands of the accuserl an,1 except the present p,: ,t tioners no others are claiming ownershi r of the money bu[ h,: :rial Court without taking into consi,]eration the said fact zrnrl t lso the recitals of the charge_sheet ancl rlso the availabilit5 rf sufficient money which is recover ed by the respondent/pcl r:e, has erroneously rejected the prayer of the petitioners. I he trial Court failed to follow the gu idelines strpLllirqd br t re Hon'ble Apex Court in a catena of decisi< ns that Page 3 of5 whenever money or any property is recovered, the same shall be returned immediately in favour of the persons claimed the same by noting down the details and taking the photographs of the same. The Courts should protect the interest of the petitioners foi releasing the amounts with proportionate ratio out of the amounts collected by them by receiving personal bonds but instead of doing so, the trial /Court had simply and erroneously rejected the request of the petitioners' In support of his contentions, learned counsel for the petitioners relied upon the decision rendered in a case between Sunderbhai Ambalal Desai Vs. State of Guiaratr

Learned assistant public prosecutor opposed the present criminal petition mainly contending that unless and until the trial is concluded and the Court comes to a conclusion that the money recovered by the respondent/ police belongs to the petitioners, the interim custody of the same cannot be given to the petitioners at this premature stage to prevent multiplication of litigation.
7. The record shows that a case against the accused Nos. 1 to 3 has been registered for the offences under Sections I fi2-DawSuit (SC) l:a6 \ - _ -' .J - Paee 4 of5 l2O-8, 42o, . (i8 and 471 IPC alleging that they have lured 87 victims, in< h-Lrl ng the petitioners, to pa_rt with their har d earned money orl th: pretext of allotting them double lted roor r houses from the G,rvr rnment.
