With their consent, this writ petition is being taken up for disposal.

This writ petition is filed questioning the action of the official respondents in interfering in the petitioner's land in H.No.22-3-947-950, Purani Haveli, Hyderabad (hereinafter referred as 'subject property'), which is subject matter of E.P.No.195 of 2024 and not taking action on the petitioner's complaint dated 10.03.2025 as being illegal, arbitrary and violative of principles of natural justice and with a consequential Prayer seeking a direction to respondents not to interfere into the petitioner's subject property.

Learned counsel for the petitioner submits that two complaints have been given on tb.Oa.ZOZS and 04.04.2025 wherein the complaint dated O4.O4.2O25has been given to respondent Nos.2 and 3, Assistant Commissioner of Police, Mirchowk, The Station House Officer, Mirchowk Police Station in which the allegations were made against one C.I. Ravinder Goud who colluded with un-official respondents to grab the subject property and that there are allegations of bribe and that the petitioner's sons were detained by \ \ I 2 the police from12 mid-night till 03:30 AM i.e., intervening night of 11.03.2025 and 12.03.2025 and,a reference was made to the complaint dated ro.o3.2o2s.

Learned Assistant Government pleader appearing for Home has placed the written instructions submitted by Sub-lnspector of police, Mirchowk Police Station wherein it is submitted that on 09.03.2025 the 4m respondent received information from the local people that some persons were creating nuisance and quarrelling with each other at Choti Kaman Purani Haweli, Hyderabad. 4th respondent visited the spot and revealerl that there is a civil dispute between the petitioner and un-official respondent Nos'6 to 9 as such suggested them to approach the competent civil Court for redressal and disbursed the crowd and refurned to police station. Thereafter, on 10.03.2025, 4t1, respondent received two separate complaints from the petitioner and 7th respondent with regarcl to land clispute. Based on the said complaints made petition entries and visited the subject property and 7ft respondent stated that he has obtained injunction orders in respect of property bearing Municipal No.?2-z-947/27 admeasuring 100 square yards situated at Purani Haveli outside Dabeerpura, Hyderabad by orders dated 05.03.2025 in I.A.No.24l of 202s ino.s.No.gg6 of 202s passed by the Hon,ble XX Junior Civil Judge, City Civil Court at Hyderabad and the petitioner also stated that he has also obtained Preliminary Decree in partition suit vide o's'No'607 of 2009 by its orders dated 26.07.2o1gpassed by Hon'ble lsr Senior Civil Judge, City Civil Cou rt at Hyderabad in respect of property bearing Nos'22-3-9f to g50, 22-3-g4g, 22-3-950 and the portion of premises No.22_3_ / 3 94T rctaladmeasur ing187 square yards situated at Purani Haveli' Hyderabad andthattheTfrlrespondentishavinginjunctionorders,andthat4ft respondent stated that petitioner not to indulge in any unlawful activities in respect of the subject property and to get directions from the competent authority. Later on 11.03.2025, 4th respondent received information that petitioner along with his sons and another were creating nuisance at the subject property,while the staff of the 4th resPondent visited the spot revealed that the petitioner's son has poured petrot on himself at the instigation of petitioner and other sons, as such the staff of 4th respondent took them from the spot to prevent the untoward incident but, did not detain them' After completion of enquiries, the 4ft respondent closed the said complaints as ,,Civll in Nature" on 19.03.2025 and the same has been informed to the as well as to 7t:. respondent through Petition petitioner/complainant Management System as well as through post' Learned Assistant Government Pleader for Home submits that the case 5. has been closed as Civil in Nature and the respondent authorities are not interfering into the civil disputes between the petitioner and un-officiar resPondents'

6. per contra learned counsel for the petitioner submits that the complaint dated 04.04.2025 was not considered and drawn attention of this Court to the postar acknowred.gments wherein the compraint dated 04-04.202s was sent to the respondent Nos'2' 3 and 4' \ a \ 4

In that view of the matter, since the complaint of the petitioner dated 04.04.2025 was pending before the respondent authorities, this writ petition is disposed of with consent directing the Deputy Commissioner of Police, south zone, Hyd,erabad/respondent No.3 to consider the complaint dated 04.04.2025 and take appropriate action strictly by following due procedure as contemprated under law, as expeditiously as possible. 8 With these observations, this writ petition is disposed of with consent.
