5. The learned Siregle .iudge vide order dated 19.O9.2013 allowed the application to the extent of passing final decree only. Assailing the sarre, the appellants/responCcnts hlcd the present appeal on the foliowing grounds:

1. The order passed in application No.839 ol 2013 seeking final decr-ee in respect of Acre l0-O0 in Sv.No.57 of Shamshiguda village, Balangar Mandal, R,R. DistricL is conlrary to law and facts and is liable to be set aside.

2. The learned Judge ought to have seen that while seeking up final decree, the State was necessary party to the proceedings since the properties in respect of which Iinal decree was claimed is vested vl,ith the Government, consequent upon abolishing of Jagirs.

3. The learned Judge ought to have scen that by not ordering notice to the State, serious prejudtce is caused to the interest of the State in the subject lands.

4. The learned Judge ought to have appreciated that the proceedings being civil in nature notice has to be ordered and had notice been given to the State appropriate claim would have been made in respect of the property. 3 C SA. No 5 012017 AFp rca on No 839 of2013

6. Heard the lcarned counsel for the parties and prlrused the material made a.,rrilable on the record 4 Applicalron No339 ot2013

7. For better appreciation, it is necessary to excerpt the order C.S- No.7 of l95a dated 19.O9.2O13 passed in Application No.839 of 2013 in C.S. No.7 of 1958 by the learned Single Judge "The Court made tl-re following order: This is an application frled to pass a linql dccree in favour of the petitioners 1 and 2 in respect of lald measuring Acs.1O.O0 guntas, in Sy.No.57 of Shamshiguda village, Balanagar Mandal, Ralga Reddy District, on payment of requisite stamp duty and direct the Receiver-cum-Commissioner to deliver the physical possession of the land to the petitioners. It is stated that already paper publication is ordered in Application No.495 of 2OO9 and the same was published and Iiled in the Court. Thereafter', the Commissioner hlcd his report on t7 .o7 .2009. The learned counsel for the lespondents have no objection in aliowing the application since they have entercd into a comPromisc. Sri M.A. Bari, Learned Senior Counsel, Rcccivcr- cum-Commissioner also submits that hc has no objeclion for passing a ltna-l decree. In view of the averments stated in the affidavit filed in support of the application ar-rd since there is no objection from anybody, this application is allowed to the extent of passing hnal decree only. Sri M.A. Bari, Senior Counsel, who is Receiver- cum-Commissioner is entitled to receive the remuneration at the rate of 2ok on the value of the ) App,i.a on No.a39 oi2013 propert\: and the petitioners are directed to pay the sanre at the time of delivery of possession of the prrrperty."

8. The aforesard order was foilowed by the decr:e dated

No.7/i958 is a suit for partitr,r'-r and separate possession respect of the Matru (r properties of Late Nawab Moinduddowla Bahadur, forming Paigah Asmajahi. The Hon'ble High rlourt has passed a preliminar5r decree in C.S. ',,1o.7/ 1958 on 6-4-7959 by virtue of a cornpr-rmise, under which the Plaintiff and Defeurt:rnt No. t have received the cash, mansions, urban properties a:rd securities, therefore the share o[ Delendants No.2 to 22 are determined, hold:ng them entitled to receive their shares in a1l othc" snit schedule properties including the propcrt,es shown in item No.23O to 254 of schec.lrrle "A" alnexed to the preliminar5r decree.

2.Thar rhe property in Sy.No.S7 of Shamsiguda villagt: Balangar Mandal, R.R. District is part of item .,,1c.252 of schedule "A" appended to the prelim Lnary decree, which is the Matruka proper t.es of Moinuddowla Bahadur, wherein the Defenrlirnts No.2 to 22 are held entitled to receive the <lt r share in terms of the preliminary decree in C.S No.7/ 1958. The Chief Commissioner Land Admin istration, Govt., of A.P., submitted a report to thc Government of Andhra Pradesh Revenue Dep:Lrtment, A.P. Secretariat vide CCLA LR.No NA2/206/2OO9 dated 22-O2-2OIO, 6 HAC,J&I\VSK,J OSA. No 5 ot20l7 Appliorion No.839 ot 20l3 c.s. No 7 0I1958 conflrming that the in Sy.No.57 of private patta land Shamsiguda vil1age, belonging to Paigah Asmajahi. The said proceedings have trecome final and therefore the Government of A.P., represented by the Respondents No.176 to 178 rs bound by the preliminary decree as well as this lina.l decree,

3. That the Petitioners No.1 to 4 have acquired the property in Sy.No.57 of Shamsiguda village, Balangar Maldal, R.R. District, being part of item preliminary decree, to an extent of Ac. l-Gts., undcr two sale deeds both dated l2-03-2OO4 executed by the Share Holders/ Defendants. The Petitioners No. 1 to 4 have been brought on record as Defendants, having purchased the property the Petitioners No.1 to 4 are in physical possession o[ the property measuring Ac.tO-OO Gts., out of Sy.No.S7 of Shamsiguda village. The Petitioner No.2 to 4 have empowered pctitioner No. 1 to act as their GPA, and accordingly, per:nission is granted.

4. That as per the orders of the Hon'ble High Court in App1.No.495/2009 in C.S. No.7 of 1958, the Receivers-cum-Commissioners have submiLted the scheme of partition along with thc plan. dividing the property by metes and bounds among the share holders. While preparing the scheme of partition, the Petitioners No.1 to 4 being the alienees pendent 1ite, have also hled the work memo before the Receivers-cum-Commissioners, requesting them to accommodate the in the scheme of partition, as they are the bona frde purchasers. Accordingly the Receivers-cum- 1 )SA No.s ol20l? AppLro tion No,a39 oi20r3 i.S. No.7 or 1958 ComnLissioners have found the Petitioners No.1 to 4 rn physical possession of the property lnss5rr:ing Ac. 1O-00 Gts., in Sy.No.57 of Shamsiguda Village and have accommodated the Petltioners No.1 to 4 and specifically allotted Ac. I0 (lO Gts., of land to the Petitioners being the purr:J: zLsers from the share holders, and shown the sarrc r-r thc plan by metes and bounds.

5. l'hat by virtue of the purchase of the property mens rring Ac. 1O-O0 Gts., out of Sy.No.57 of Shar siguda Village, arrd the fact of accor:rmodation of the Petitioners under the scherrc of partition, entitled the Petitioners to get Lhe p -r:scnt hnal decree passed in their favour.

'lf erefore this Court do hereby grant the final dccree in lavour of the Petitioners No. 1 to 4 jointlv in r e:;pecL of the land measuring Ac. 1O-00 Cents , in S; \o.57 o[ Shamsiguda village, being the alicn ,'s pendent lite, which is sho'r'n in the sche<lu1e and the plan in red color appended to this Inal decree. Thus by virtue of this hnal decrre. the Petitioners No.i to 4 are be and hereby decla red as absolute owners of the land measuring Ac. lo O0 Cents., in Sy.No.57 of Shamsiguda Vi11a11:, Balanagar Mandal, R.R. District being part of it,rrn No.252 of schedule "A" artnexed to the prelirr inary decree in C.S. No.7/ 1958, being the alicnees pendent lite, more specifically shown in thc schcdule and the plan in red color annexed to this inal decree.

Tlrat the respondents 172 and 173 herein as pu::cnased extent of Ac. 1OO.O0 gts of land in Sy.N:.57 of Shamsiguda Vi11age, Under the assip:nment deed dated: 16.09.2010 the \ o HAC,J&M/SK,J Appli.ation No.a39 ol20 l3 - conveyance deed dated: 03.08-2003 and the registered deed of declaration deed dated 12.O8.2O1I which is registered orr as a document No.293llV /2011 try the District Registrar, Rarga Reddy District which has given them exclusivc right to seek final decree for which the respondents 772 and 173 have filed a-s separate final decree application arrd for passilg oI hnal decree in favour of the respondenls I72 atd 1,73 to the extent of Ac. 100.00 gts, the petitioners have no objection.

8. That the Petitioners No.1 to 4 are be and hereby directed to pay the rcmuneration to the Receivers- cum-Cornmissioners in respect of the land linally dccleed in thcir lavour within two ucr.ks.. On a perr,Ls.rl of the above, the learned Single Judge irr the order dated 19.09.20 t-, recorded that the respondents had no olrjection in allowing the ap pJ Lcation since they have entered into compromise lt is also obscr'\ e, I Lhat already paper publication is c rdered in Application No.'l(l:j of 2OO9 and the sarne was published aed filed in the Court and thereafter, the Commissioner frled his report on 17 .O7 .2OOg . I t i s further recorded that the learned Senio- Counsel, ' Receiver-cum-C c, rimissioner also submits that he has no ol,jection for passing a final dlrrrcc. Recording the above, the learned Sir-rgle Judge allowed the appli,: rtion to the extent of passing hnal decree 'lnly.

10. However, in thc copy of the Iinal decree, there is no Inention or reference abou the compromise of the appellants herein, who represent.s the SLate. In the decretal copy, it is declar'.:d that the respondents hcr -'rn :1re the absolute owners of the subjt ct land of Acs. 10.00 gunt: si in Sy.No.57 of Shamshiguda village Balangar Mandal, R.R. D Lr;trict being part o[ item No.252 of scl-redule "A" annexed to the l,rcliminary decree in C.S. No.7 of 1958. It- is further recorded that rhe rcspondents No.l72 and 173, it.r the dccree, have purchased cxtf r'rI of Acs.100.00 guntas in Sy.No.S7 of Shrlmshiguda village, under th,,' assignment deed dated 16.09.2OlO, the r.:onveyance deed dated 03.08.2003 and the registered deed of declaration deed dated 12.O8 .t\- 1 I , which is registered on as a document 10 TIAC,J&NVS(,J osA. No.s 0t 2017 Application No.a39 ol20l3 C.S. No 7 of 1958 No.293llv l2O1 1 by the District Registrar, Ranga Reddy District which has given them exclusive right to seek final decree for which the respondents 172 and 173, in the decree, have hled separate final decree application and for passing of final decree in favour of the respondents 172 arrd 173, in the decree, to the extent of Acs.100.00 guntas, the respondents herein have no objection. It is to be noted that in the para 7 ol ttre hnal decree dated 19.09.2013 drafted in Application No.839 of 2013 in C.S. No.7 of 1958 is not forming part of the order dated 19.09.2013 passed in Application No.839 of 2013 in C.S. No.7 of 19518 by this Court, which has been allowed to the extent of passing Iinal decree only. As such, there is discrepancy in the order and ir-r the decree dated 19.09.2013.

11. At this juncturc, it is significant to note that the Division Bench of this Court vide order dated 09.01.2025 closed the C.S. No 7 of 1958 wherein at para No.36 observed as under: "36. On a perusal of the paragraph (g) of the preliminary decree dated 06.04. 1959, it is evident that the defendant Nos.2 to 22 were entitled to the properties mentioned at item Nos,23O to.254 of Schedule 'A' anncxed to the preliminar5r decree, in case the sarne are restored or relcased in favour of Asman Jahi Paigah. In the instalt case, adrnittedly, there is no material to indicate that the properties mentioned at senal No.230 to 254 of Schedule A' to the preliminary decree have been restored. or released in favour of Asmal Jahi Paigah. It is pertineni to note that as per para 4(g) of the preliminary decree dated 06.04.1959, the 1l I Aq, J & NVSK, J C iA No 5 ol20l7 AppTrca on No.839 ot20l3 C S. 12. The subjecl l)roperty under appeal is in respect of Itern No.252 (Shamshiguda) c,f Scheclule-A of the suit. The Division Benr:h of this Court vide order rlrrtcd 09.01.2025 had closed the C.S. 13. It is to be noted that the C.S. No.7 of 1958 was closed with C S No-7 ol1958 specific observation that no lands are available for partition in Item No.252 Schedule-A and the subject land i.e. admeasuring Acs.1O.OO guntas in Sy.No.S7 of Shamshiguda village of Schedule A,of tl.re suit Balangar Mandal, Ranga Reddy District. 1,4. In vierv of the above discrepancies found in the order and the decree dated 19.09.2013 and also taking into consideration the specif,lc observations rnade in C.S. No.7 of 1958 that no lands are available for partition in Item Nos.23O to 254 of Schedule "A" attached to the preliminary decree and in thc absencc ol preliminary decree for item Nos.230 to 254 in Schcdulc "A", no hnal decrcr: could have been passed, impugned order and decrec dated i9.09.2013 passed in Application No.839 of 2013 in C.S.
