The facts of the case in brief as staterl are that the petitioners claims to be owners of agriculture larr [s at Jalimudi and Gannavaram villages of Madhira and \v ,,ra Mandals, Khammam District respectively. It is submitted th: t Government had proposed lor construction of Anicut across the wyra river near Jalimudi village, Madhira Mandal whi<:lr is a rninor irrigation project. As per said proposal, Govt_- rment issued 2 ' Ac.59.39 guntas Pertaining notifrcation dated 14'O3'20L2 under Section 4(1) of Land Acquisition Act and same was published in the news PaPer on 21.03.2012' lt is further submrtted that lands in SurveY Nos'313 and 314 to an extent of Ac.o1.35 guntas Pertaining to Gannavaram village and in Survey Nos.156 , 178' g' 8' 7 ' 3l' 27 28, 29, 10, 11, t2' rs', t5' 20' 22,23,24,25' 26 to an extent of to Jatmudi village are sought to be acquired. It is further submitt ed that there is no consistency ln fixing market value by the resP ondent No.4 and Process adoPted by him is not in accordance with law' Subsequently' in respect of petitioner No'34 who is owner of land in Survey No'156/ 1/AA is concerned as Per frrst award dated 29'O6' 2OL2' he was awarded with compensation of Rs 2'97'000/- per acre, as Per second award dated 12'07 '2013' he was awarded with comPensation of Rs.4,75,OOO/- per acre and as Per third award dated 27.o5.2015' he was awarded w1th comPensation of Rs.10,OO,00O/- per acre' After award dated 29 06'2012 petitioner Nos' 34 and 36 have submitted a representation on respondent No'2 for granting appropriate 18.03.2013 to the government have enhanced the comPensation' Thereafter' comPensation in resPect of remaining land' He further requested the authorities to lx market value since present market value rs Rs.18,00,0O0/- per acre. Since no action is forthcoming on the said representation' the present writ petition is filed' l I J

Subseqrir ntlv, in respect of 1) Jalimudr village, Madhira Mandal awarded t s.2.92 ,OOO / - to an extent of Ac.59.39 guntas passed on ,,>_i.06.2012 and payment was made on 14.07.2013 under Land .,cquisition Act, 1894, 2l Jalimudi village, Madhira Mar dal, awarded Rs.2,97,OOOl- to an extent of Ac.46.lOYz gu]n as passed on I2.O7.2013 anci payment was made on I4.O7.2O l3 under Land Acquisition Act, 1894, 3) Gannavaram villagr, Wyra Mandal awarded Rs.4,75,000/ to an extent of Ac.l7. 1l guntas passed on 12.07.2072 and payment was made on 1.1 r7.2013 under Land Acquisition Act, 1894 and 4) Munagal Vangaveedu, Siripuram, Jalimudi, Rompimall and Mallaram vrl ages, Madhira Mandal awarded Rs.9O,000/- to an extent of Ac.() i.26vz g;,rrtas passed on 25.O5.2O15 and payment was made r n 10.09.2015 under LARR Act,20i3. Awards in respect of Sl.\os.1,2 and 3 were passed by the Land Acquisition Officer and Revenue Divisional Officer, Khammam under Section 11(:2 according to Land Acquisition Act, lB94 by following due pro edure lzrid in the said act and awarded compensation. Awards ir respect of S1. No.4 pertains to six villages of Madhira Mandal r-rd the award was passed accordrng to the Rlght to tl arr Uompensatlon an Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act, 2013. It is further submitted that new Land Acquisition Act, 2013 came into force with effect from

01.01.2014 and the awards dated 26.06.2072 and L2.O7.2013 were passed by the Land Acquisition Officer and Revenue Divisional Officer, Khammam by duly following procedure and after taking consent from the farmers of the lands, whose lands were coming under the alignment. Now, there is no provision in new Land Acquisition act, 2Ol3 for enhancement of compensation for the awards which were already passed prior to OI.Ol.2Ol4 and moreover the awards were passed after taking consent from the farmers of the concerned villages and the lands which were acquired for the project and the compensation amount has already been paid and possession of the lands were taken and almost entire work proposed is also completed.

5. Per contra, learned counsel for the petitioners submitted that petitioners are not satished with the compensation paid in the awards and that they would take appropriate steps challenging the quantum of the compensation awards.

Recording the submissions made by the learned counsel appearing on either side, this writ petition is disposed of with a ) liberty to the petitioners to pursue their remeci :s as available under law. 7 .
