Judgment
Counsel for the Petitioner:MR. M.JANARDHAN RAO FOR MR.K.CHIDAMBARAM The Court made the following : ORDER: This writ petition is filed for a writ of mandamus to declare the action of the respondents in ordering closure of water manufacturing units situated at Bhimavaram as illegal and arbitrary. At the hearing, Sri M.Janardhan Rao, learned counsel for the petitioner fairly submitted that in view of the mandatory provisions of the Prevention of Food Adulteration Act, 1954, which is replaced by the Food Safety and Standards Act, 2006, the petitioner cannot carry on the water manufacturing activity for the purpose of supplying drinking water without obtaining the BIS Certificate from the competent authority. He, therefore, requested for closing the writ petition with liberty to the petitioner to resume it’s operations after obtaining the BIS Certificate, if not already done. Having regard to this representation, the writ petition is dismissed with liberty in terms of the prayer made. As a sequel to dismissal of main petition, interim order, dated
28.06.2005 is vacated, WPMP.No.17625 of 2005 is dismissed and WVMP.No.2136 of 2005 is disposed of as infructuous. C.V.NAGARJUNA REDDY, J 22nd JULY, 2008.
