BHASKAR REDDY WRIT PETITION No lO75O of 2025 ORDER: This Writ Petition is filed praying this Court to declare the action of respondent Nos.3 to 5 in not considering the online application urde No.2500O 12272 dated. 22.O2.2025 of the petitioner and not initiating to change the classification and nature of the land and delete the land of the petitioner i.e., land admeasuring Ac.O.2L gts., in Sy.No.2SslA2l 1AA, Ac.1.O1 gts.,. in Sy.No.255/A2 12, total admeasuring Ac.t.22 gts., situated ar Ramanjapur Village, Shamshabad Mandal, Ranga Reddy District, from the list of prohibited properties, as illegal, arbitrary and violative of the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O (for short, ,the Act, 2O2O) and. consequently, prayed for other appropriate reliefs.
2. Considered the submissions made by the learned counsel for the parties and with their consent, this writ petition is being disposed of at the admission stage.

It is stated that the petitioner is the owner ald possessor of the agricultural land admeasuring Ac.O.2 I gts., in Sy.No.255/A2l 1AA, Ac.1.01 gts., in Sy.No.2SS/A2/2, total admeasuring A91.22 gts., situated at Ramanjapur Village, a I ) CVBR, J wp 10750-2025 Shamshabad Mandal, Ranga Reddy District, having acquired through succession. It is further stated that the name of the petitioner has been recorded in the revenue records and the revenue authorities aiso issued pattadar passtrook under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, l97l (for short, 'the Act, 1971J in his favour in respect of the subject property uide Passbook No.418836, Khata No.536. It is further stated that the petitioner is also receiving various incentives sanctioned by the Government as investment su$sidies. It is further stated that the respondents, while updating the revenue records as per the provisions of the Act, 2O20, without taking into consideration of the said documents, have classified the nature of subject property as ceiling land instead of patta land and mentioned the same in the list ol prohibitcd property in Dharani Portal. Having noticed the same, the petitioner has made an online application bearing No.250O01272, dated 22.02.2025 seeking for deletion of the subject property from the prohibited property in Dharani Portal. The grievance of the petitioner is that even after receiving the said application, the respondent authorities did not consider the same. Hence, the present writ petition. 3 C!'BR, J Wp 10750 2025
4. Sri L.Ravinder, learned Assistant Government Pleader for Revenue has not disputed issuance of pattadar passbook in his favour under the provisions of the Act, 1971, wherein the subject property is classified as patta land.

It is settled law that once the nature of the land is shown as patta land and pattadar passbook has been issued in favour of the petitioner, the respondent authorities are not having any power or authority to notify the subject property as prohibited property either in Dharani Portal or in the list of prohibited properties maintained under the provisions of the Registration Act, 1908 (for short, 'the Act, 1908).

In the said circumstances, this Court deems it appropriate to dispose of this writ petition directing the respondent authorities to examine the application bearing No.25O001272, dated 22 'O2 '2025, submitted by the petitioner, duly taking into consideration of the documents enclosed by him and if the said application complies with all the requirements of sub-section 4 of Section 22A of the Act, 1908 and if the same is not the government property, consider the same and delete the subject property as prohibited property in Dharani Portal. In the event if the petitioner is otherwise not eligible .for the same, the respondent authorities shall pass a i I Il 4 CVBR, J wp 10750 2025 reasoned order and communicate the same to the petitioner. The said exercise shall be completed within a period of eight (O8) weeks from the date of receipt of a copy of this order.
7. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
