RAPOLU BHASKAB Counsel for the Rqspon{entq1 SRI L.RAVfNPER, AGR FOR BEVENUE The Cqurt r"ne(e the following: ORPER / HON'BLE SRI JUSTICE C.V.BHASKAR REDDY V/RIT PETITION No.10688 of 2025 ORDER: This writ petition is filed declaring the action ol the respondents in not cortsidering the applications for Appeals on Demarcation, dated 2 1 . 1 I .2024 and non-conducting the survey and demarcation of the agricultural land admeasuring Ac.\ .24 guntas in Sy.No.282 l6/a12, situated at Jammikunta Vitlage and Mandal, Karimnagar District, as illegal, arbitrary and against the principles of natural justice and consequently, prayed for other appropriate reliefs. It is stated that petitioner is the owner agricultural land 2. admeasuring Ac.l.24 guntas in Sy.No.282 /6 / a/2, situated at Jammikunta Village and Mandal, Karimnagar District. It is further stated that the name of the petitioner was recorded as pattadar and pattadar passbook bearing No.T17O7OO64377 uide Khata No.2681OO was issued in his favour under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O (for short "the Act 9 of 2O2O"l. It is further stated that when some of the neighbouring land owners have started disturbing the boundaries of the subject land, the petitioner had submitted application for Appeals on Demarcation, dated 24.11.2024 to th,e / / 2 CVBR, J Srp_10688_2025 I respondent authorities, by paying requisite fee for conducting survey of the subject land and fx the boundaries. The grievance of the petitibner is that even after receipt of the said application the respondent authorities are not conducting survey and hx the boundaries.

Considered the submissions of the learned corlnsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is being disposed of at the admission stage. In view of the nature of relief sought for in this writ petition, issuance of notice to the unofficial respondents is dispensed with.

Sri Rapolu Bhaskar, learned counsel for the petitioner has submitted that in terms of the circulars issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the applications within 45 days from the date of the applications after collecting necessary charges.

Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondent authorities has submitted that as per the circular instructions issued by the Commissioner, Survey, Settlements and Land Records urlCe Rc.No.Nl16543/99, dated 25.O7.2O01, Rc.No.N1/14O8/O7, dated 13.07.2OO7, and r J CVBR, J Wp_10688_2025 Rc.No.N2/ l74l l2OtO, dated 1B.05.2010, the petirioner has to make F-Line application seeking to conduct Field Measurement Survey before respondent No.4-Tahsildar. instead of making F_ Line application before the Tahsildar, who is competent authority to conduct survey as per the aforesaid circular instructions, the petitioner has straight away made the application for Appeals on { t Demarcation. Learned Assistant Government pleader further submits that if the petitioner liles F-Line application and the said application complies with alr the requirements of the said cirourars, the respondent authorities will consider the same.

In view of the above submissions, this Court deems it appropriate to dispose of the writ petition permitting the petitioner to make F-Line application, duly enclosing the documents and land particulars, which are necessary for conducting survey and in the event of such application being submitted by the petitioner and if the petitioner - fulfils all the requirements mentioned in the circulars issued by the Commissioner, Survey, Settiements and Land Records from time to time, respondent No.4 shall conduct the survey, after issuing notices to ali the persons interestecl and adjacent pattadars and after considering their ob-lections, within a period of eight (8) weeks from the date of receipt of the application. 1 CVBR, J Wp_10688_2025 7 With the above observations, this Writ petition is disposed of.
