Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare that the impugned action of the respondents in not fixing the seniority of the petitioners notionally in the cadre of School Assistant (Social) from the datq of appointments made to the lower rank and marks of candidates of TRT-2017, while considering the cases of similarly placed persons due to their administrative delay for issuing posting orders along with others is illegal, arbitrary, discriminatory and violation of Articles 14 and 16 of the Constitution of lndia and consequently direct the respondbnts to fix the seniority of the petitioners notionally in the cadre of School Assistant(Social) from the date of appointments made to the lower rank and marks of candidates TRT-2017, w.e.f . 15-07-2019 instead of 15-06-2024 due to administrative delay, with all consequential benefits viz., arrears of salary, and fixation of Revised Pay Scales from time to time as per the orders of this Hon'ble Court tn W.P.No.1494112014 dt.13.07.2022 and W.P.No.3213212022 d1.23-O8-2022 and W.P.No.34585 of 2022 dt.05.09-2022, W.P.No.8 of 2024 dt.03-O1-2024 and WP.No.184312024 d1.25-01-2024 in the interests of justice. lA NO: 1 OF 2025 . 2. Heard Sri M. Ramgopal Rao, learned counsel for the petitioners,andlearnedGovernmentPleaderforServices-I, appearing for the respondents' Perused the material on record'
3.ThecaseofthepetitionersisthattheTelanganaStatePublic service commission (TSPSC) issued Notification No.5212017 under TRT-201TforrecruitmenttoVariousposts,inc|udingthepostof school Assistant (social) in Telugu Medium. The petitioners, having met the eligibility criteria, appeared for the written examination and secured76.589and77-475marks,withStateRanks67and45, andDistrictRanks16andl0,respectively.Despitehavinghigher merit, their results were withheld due to alleged suspicious bubbling in their OMR sheets, though no discrepancies were found' Asaresult,thepetitionerssubmittedarepresentation,butno action was taken. Therefore, the petitioners filed W.P.No.30294 of 2023. This Court, by order dated 06'tL'2023, directed the petitioners to submit a fresh representation, which was considered, and appointment orders were issued ybe Proc.Rc.No.A5/1230/ 2 2024, dated 15.06.2024. It is further the case of the petitioners that while less 4. meritorious candidates were appointed on 15.07.2019, the petitioners were appointed only on 15.06.2024 due to administrative delay. As a result, the petitioners now seek notional seniority from t5.07.2019, with all consequential benefits, including arrears and pay fixation. The petitioners rely on judgments in W.P.No.1494l of 2O\4, dated 13.07.2022, W.P.No.32t32 of 2022, dated 23.08.2022, W.P.No.34585 of 2022, dated 05.O'g.2022, W.P.No.B of 2024, dated 03.01.2024, and W.P.No.1843 of 2024, dated 25.01.2024, where similarly placed candidates were granted relief.
5. Learned counsel for the petitioners submits that due to the delay on the part of the authorities, the petitioners' seniority has not been counted. As such, the petitioners submitted a representation on 29.12.2024, requesting for service count and sanction of arrears from t5.07.2019 to 14.06.2024 under TRT Notification No.52l20L7 for the post of School Assistant (Social Studies).

Learned counsel for the petitioners submits that appropriate orders be passed in this Writ Petition, directing the respondents to / -L--_ 3 consider the representation submitted by the petitioners on 29.12.2024 and pass appropriate orders in accordance with law. 7. Learned Government pleader for Services_I, appearing for the respondents, submits that the delay is on the part of the TSPSC and not on the Government, and he has no objection for the disposal of the petitioners' representation dated 29.12.2024.

Taking into consideration the submissions made by the learned counsel for the respective parties, without going into the merits of the case, this Writ petition is disposed of, directing respondent No.2 to consider the petitioners, representation dated 29.L2.2024, and pass appropriate orders in accordance with law, as expeditiousry as possibre, preferabry, within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed. //TRUE COPY// SD/.P.
