MADHAVI DEVI WRIT PETITION No.10414 of 2025 ORDER: This Writ Petition is filed seeking a Writ of Mandamus declaring the letter bearing No.D1i416l2024 dated 21.03.2025 issued by respondent No.5 proposing to withdraw 300 food security cards from the lair price shop of the petitioner bearing No.3612019, Godavari Khani, Ramagundem Mandal, Peddapalli District, as illegal and arbitrary and consequently to set aside the same. 2 Ms. Katyayini, Icamed counsel representing leamed counsel for the petitioner submitted that the petitioner is the fair price shop dealer of shop bearing No.3612019, Godavari Khani, Ramagundem Mandal, which is having 1380 cards, whereas respondent No.7, who is the fair price shop dealer of.shop bearing No.36i2041, Godavari Khani, Ramagundem Mandal, is having 660 cards and he is also running an additional in-charge shop, which is having 843 cards, i.e., a total of 1503 cards. Learned counsel for petitioner further submitted that there is no rationale in 2 TI\,4 DJ w) 70414 2025 removing tlu: cards from the fair price shop of the petitioner and allotting therl to the fair price shop of respondent No.7.

Leruned counsel for respondent No.7 relied upon the averments rnade in the counter affidavit, wherei, it is stated that respondenr No.7 has been alrotted only 660 cards and rhe additionai in-charge cards have been thrust upon respondent No.7 alLd in order to rationalize the number of the regular cards in accor.clance with G.O.Rt.No.-(5 dated 12.05.2015, 300 cards have bcen ,rllotted to the fair pli,:,: shop of respondent No.7. Learned cr.,unsel for respondent )i,r.7 further submitted that even after the said allotment of 300 carrlsr to the fair price shop of respondent \o.7, the petitioner ,,voLrld be left with more than 1000 cards.

Learued counsel for the petitioner, however. r;ubmitted that some of the cardholders retained by the respondent a uthorities in fa'our of rhe petitioner might have died and without 'r:rification and witl.rout issuing any notice to the petitioner, the impug.red order has been passed. 'Iherefore, she is seeking an opportuniry for the petitioner to make his submissions with regard to the carCs where the cardholders might have expired or left. ./ I wp_LO474_2025
5. Learned Govemment pleader for Civil Supplies submitted that he has received para-wise remarks and seeks time to file a counter affidavit.
6. In view of the above submissions, this Court deems it fit and proper to permit the pctitioner td make a fresh representation with regard to the cards, where the cardholders have either died or are not available, within a period of 10 days from the date of receipt of a copy of this order and thereafter, the respondent authorities shall pass appropriate orders thereon. Till such an order is passed by the respondent authorities, the impugned letter dated
21.03.2025 issued by respondenr No.5 is suspended.
7. With the above obserwations, this Writ petition is disposed of.
