Dis No. 30672(1yMA-Cl2O24 dated 18.10.2024 on Petitioners Medical Bill fonarrarded by the 3rd Respondent/ Registrar, High Court and paid only Rs. 75,0001 out of Rs. 3,83,308/- as illegal, arbitrary and violation of principles of Natural Justice guaranteed under Articles 14,21 and 309 of Constitution of lndia and subsequently direct the 2nd Respondent to release the amount of Rs. 3,08,308^ towards Petitioners Medical Bill forwarded by the 3rd RespondenURegistrar vide Lr. Ramachandra, leamed counsel for the petitioner and Mr. G.Prasanth, leamed Assistant Govemment Pleader for Services I for respondent Nos. 1 and 2. Perused the record.

Though the respondent-State was granted time to file counter, however, the leamed counsel for the State expressed his inability for not receiving proper instructions on account of which the counter could not be filed. However, perusal of the record and the pleadings and also upon hearing the leamed counsel for the petitioner, we find that recently there was another identical matter which came up for hearing before this Fligh Court in W.P.No.46677 of 2022 which stood decided on 04.01-2023 and the Division Bench of this High Court while allowing the said writ petition made the following observations: "3. The issue raised in this writ petition is no more res rntegra. Similar issue arose for consideration before this Court 2 in W.P.No.26210 of 1995. ln the said writ petition also petitioner was an employee of High Court and when he submitted medical bills for reimbursement, small amount of reimbursement was granted from out of the total expernditure incurred by him for treatment. The respondents have t.aken a stand that even the employee of High Court was-not entifled to full reimbursement of the expenditure incurred by him. Overuling the said objection, the Division Bench t-,eld as under: "ln view of the above, it has to be declared that the restrictions as in G.O.MS.No.184 or any other order of the Government upon the reimbursement of the medical expenses to the Government employees are iot applicable to the employees of the High Court unless they are made applicable by the Chief Justice of the Couri. The rmpugned Government Order rejecting the claim of the petitione[ in the aforementioned lefter bf the seccnd respondent herein thus is wholly without jurisdiction, the same is accordingly quashed. Respondents are direcled to consider the claim of the petitioner in the light of lhe rules unetfected by the Government Orders imposing restrictions upon the reimbursement of the medila-l aftendance/treatment costs by various governmont Orders, strictly in accordance with the Andhia pradesh lntegrated Medical Attendance Rules, 1972 as modified from time to time in consultation with the Chief Jushce of the High Court. ln view of the directions aforementioned no further discussion of the issues raised by the petitioner herein is required."
4. Similar issue was raised in W.p.Nos.19613 of 2O0S and 22645 of 2020. Following the decision in W.p.No.26210 of 1995, W.P.Nos.19613 of 2005 and 22645 ot 2O2O are alt,lwed. 5. According to the 3d respondent, no Rules are forn,ulated by the Hon'ble Chief Justice of the High Court ald no restriction is imposed on the employees working in thr: High Court. Therefore, the principle laid down by the Division Bench of this Court in W.p.No.26210 of 199S holds field and in terms thereof, petitioner is also entifled to full reimbursem ent of medical expenditure incurred by him for his treatment. -''t't-"'' ..,-,. 3
6. Following the said decision, this Writ Petition is also allowed and the respondents I and 2 are directed to reimburse the balance amount after deducting Rs.1,00,000/- already paid to the petitioner within a period of three months from the date of receipt of copy of this order'.
3. Upon plain reading of the order of the Division Bench referred to above, we find that the present matter also being of identical nature can be disposed of in similar terms
4. Accordingly, the present writ petition also stands allowed. The respondents are directed to scrutinize the bitls raised by the petitioner for reimbursement and whatever is the admissible amount, the same shall be released forthwith without any further delay.
