Oral order: Heard the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition on behalf of respondents. The substantive grievance of the petitioner is as to the failure of the 2nd respondent in disposing of the petitioner’s Arbitration Application filed on 29-2-2002 under Section 3G (5) of the National Highways Act, 1956 (for short ‘the Act’) which is stated to have been numbered as 3789/02 G1. The petitioner’s rice mill and land in an extent of 484 Sq. yards in Sy.No.179/2B in Buragam Village, Kanchili Mandal, Srikakulam District is stated to have been acquired under the provisions of the Act pursuant to a notification dated 19-9-2001. The competent authority thereupon passed an award. The petitioner, dis-satisfied with the quantum of compensation and having other grievances, preferred Arbitration to the 2nd respondent as per the remedy available to him under Section 3G (5) of the Act. Such a remedy was pursued on 29-2-2002. Despite the lapse of four years, the 2nd respondent failed to dispose of the Arbitration Petition No. 3789/02 G1 is the complaint. In the circumstances above, the writ petition is disposed of directing the 2nd respondent to expeditiously and in any event within a period of three months from the date of receipt of a copy of this order, consider and dispose of the petitioner’s application dated 29-2-2002 under Section 3G (5) of the Act. The award/order of the 2nd respondent shall be communicated to the petitioner within the aforesaid time. There shall be no order as to costs. 10th November, 2006.
