BHASKAR REDDY WRIT PETITION No.1O439 of 2o25 ORDER: This writ petition is filed seeking to declare the action of the respondent authorities in incorrectly entering the name of respondent No.6 in place of petitioner's father in respect of land admeasuring ec.b.OO gts., in Sy.No. 1822/AA, siruated at Kosgi Village and Mandal, Narayanpet District, as illegal, arbitrary and consequently prayed for other appropriate reliefs.
2. Considered the submissions of the learned counsel for the respective parties and perused the record.

It is stated that the petitioner's father was the absolute owner and possessor of the land admeasuring Ac.0.07 gts., in Sy.No. 1822lAA, situated at Kosgi Viliage and Mandal, Narayanpet District and his name was recorded in the pahanies as pattadar and possesso.". it i" further stated that in the year 2O17, the name of respondent No.6 has been recorded in the pahani in place of the petitioner's father in respect of land admeasuring Ac.O.O6 gts, in Sy.No.1822/AA. Therefore, the petitioner has made a written representation dated 2O.Ol .2025 to the respondent authorities requesting to furnish information about the mutation of the name of respondent No.6 in the revenue records in respect of I I I 2 CVBR, J wp_10439_2025 Sy.No.1822/AA. In reply to the said representation, respondent No.4 has issued an Endorsement in File No.C I 125 /2O2S, dated O5.O2.2O25 stating that the land in Sy.No..1822/AA, covering an extent of Ac.O.17 gts., belongs to Kyasaram Ananthaiah, S/o. ehinnaiah and out of the said extent, Ac.O. 10 gts., of land has been granted under patta to Varla Swarupa Rani W/o. Bhalakrishnaiah, as per records. It is further stated that with regard to remaining Ac.0.O7 gts., no relevant patta transfer documents pertaining to mutation of the name of respondent No.6 in place of the petitioner's father in respect of Sy. No. lg22 / A, covering Ac.0.07 gts., have been found. The case of the petitioner is that no documents whatsoever were executed by his father during his lifetime and respondent No.6, in active collusion with the then revenue officials, got mutated his name in the revenue records in respect of Sy.No. 1822/AA and obtained pattadar passbook fraudulently.

Learned counsel for the petitioner has vehementlv contended that respondent No.6 is not holding any valid documents for transfer of patta in his favour as required under Section 4 of the Telangana Rights in Land and Pattadar passbooks Act, 1971 and in the absence of the same, he is not entitled for mutation of his 3 CVBR, J wp_L0439 _2025 name in the revenue records and consequential issuance of pattadar passbook in respect of Sy.No. 1822 / AA.
5. A perusal of the Endorsement dated 05.O2.2025 issued by. respondent No.4 would reveal that no relevant patta transfer documents pertaining to mutation of the name of respondent No.6 in place of the petitioner's father in respect of Sy.No. lg22lA, covering Ac.0.07 gts., have been found.
6. In view of the above, this Court is of the opinion that the issue raised in this writ petition has to be dealt with by respondent No.4, after conducting a detailed enquiry in accordance with law. Accordingly, this Writ Petition is disposed of directing respondent No.4 to consider the application, if any, filed by thp petitioner and after issuing notice to the petitioner and all other persons whose names have been recorded in the revenue records, conduct a detailed enquiry and pass appropriate orders, within a period of twelve (12) weekS from the date of receipt of a copy of this order.
