…Hon’ble Court may be pleased to issue an appropriate writ, order or direction particularly one in the nature of Mandamus declaring the inaction on the part of the 1st respondent herein in not releasing the stocks seized by the 2nd respondent herein vide seizure report, dated 1.11.2007, for interim custody to the petitioner, pending disposal of the proceedings said to have been initiated by him under Section 6A of the Essential Commodities Act, 1955 as arbitrary, illegal and contrary to the procedure envisaged under Section 6A of the Essential Commodities Act, 1955 and violative of fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the 1st respondent to release the stocks seized by the 2n d respondent herein vide seizure report, dated 1.11.2007 for interim custody to the petitioner, pending disposal of the proceedings said to have been initiated by him under section 6A of the Essential Commodities Act 1955 and pass such other order…

At the hearing, Sri V.R.Reddy Kovvuri submitted that since, the seizure has taken place on 1.11.2007, Joint Collector, Kurnool may be directed to dispose of the proceedings under Section 6-A of the Essential Commodities Act, 1955 expeditiously. I find this request of the learned counsel reasonable and the writ petition is disposed of without going into the merits of the case with the direction to the Joint Collector, Kurnool to dispose of the proceedings under Section 6-A of the Act within a period of six weeks from the date of receipt of a copy of this order. Subject to the above observation, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.35791 of 2007 filed by the petitioner seeking interim relief is dismissed as infructuous. ___________________________ C.V.NAGARJUNA REDDY,J Date:03.04.2008 Note: Issue c.c. in three days.
