BHASKAR REDDY WRIT PETITION No.9975 of2o25 ORDER: This Writ Petition is fi1ed praying thii Court to declare the Notices, dated 18.03.2025 and, 28.03.2025 uide No.B/3ZO/ 2023, issued by respondent No.4 as illegal, arbitrary and violative of the principles of natural justice and consequently, prayed to direct the respondents not to interlere with lhe day_ to-day activities of the petitioner,s Bick Manufacturing Unit situated in the land admeasuring Acs.2.05 guntas in Sy.No.437 /24, 437 /25/t, 432 /26 of Narsingpur Village, Jagityal Rural Mandal, Jagityal District.

It is stated that respondent No.4 has issued the impugned notices to the petitioner under the provisions of the Telangana Assigned Lands (Prohibition of Transfers) Act, 7977 (for short "the Act, 1977"1 and the Rules made thereunder and the petitioner received the impugned notices on 2g.O3.2O25. The grievance of the petitioner is that even before submission of the explanation the respondent authorities are making efforts to dispossess him from the subject land, which is in his occupation. i t \ ;t 2 CVI}R, J \\p 9975 2025

3. Conr;idered the submissions of the learned counsiel for the respective pa rtics and with their consent, this writ J etition is disposed of .rt the admission stage.

Sri FI.Somarah Ezra Sastri, learned Assistant Go.izernment Pleader for Assignment, has submitted that a detailerl enquiry has been conducted by respondent No.4 over the lands in Sy.No.437 z nd its sub-divisions, wherein the assignees, who / alleged to htve assigned the land for agricultural purpose, are utilizing tltc said land otherthan the agricultural purpose, thereforc pro::eedings have been initiated under the F,rovisions of the Act., 1')77. 5. Be th:rr- :rs it may, in this writ petition the irnpugned orders are () nly show-cause notices. It is settled larv that against thr show-cause notices, writ petition is not maintainable and the petitioner is entitled to hle aporopriate 7 3 C\,'BR. J wp 9975 2025 explanation and after passing orders, he has right to agitate his grievance before the appropriate forum in accordance with law. Therefore, this Court deems it appropriate to di-spose of this writ petition, leaving it open to the petitioner to submit appropriate explanation to the impugned show-cause notices within a period of (15) days from the date of receipt of a copy of this order and on such explanation being submitted by the petitioner, the respondent authorities are directed to consider the same and pass an appropriate reasoned order in accordance with law and comlnunicate the same to the petitioner, within a period of four (Q4) weeks from the date of receipt of the explanation.
