Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the 3rd respondent as in issued the impugned order vide its Rc.No.689/2000-D dt.9.8.2002 is as illegal, without jurisdiction, arbitrary and violative of Sec.31(a)(b) of the APCS Act 1964 apart from being violative of Art.14 and principles of natural justice and consequently direct the respondents to hold the elections as per section 31(2)(b) of the said Act and allow the elected President of the society to draw the payments due to the society from various departments including 4th respondent like authorities for the works already executed and to pass such other orders as are necessary in the interest of justice. ORDER:
By impugned order dated 09.8.2002, the third respondent appointed the Sub Divisional Cooperative Officer, Mahabubabad as Person-in-charge of the petitioner Society for a period of six months or till the election to the Managing committee is held. Though this Court admitted the writ petition filed against the impugned order, the interim order was refused. Further, it is brought to the notice of this Court that the elections were held on 05.8.2002 to the petitioner society. In that view of the matter, the cause of action does not survive.
