06.02.2025 on the ground of pending criminal case uide Cr.No.7 of 2016, PS Mulugu, Siddipet District for the offences punishable under Section l2O-8, l2l, l2l(A) r/w 34 IPC, under Section.lO, 13, 18, 188 and 20 of UA(p) Act, Section 8(1)(2) of Telangana State Public Security Act, 2012, which is pending tratl uide SC No.6 of 2023 on the file of Principal District and Sessions Court, at Siddipet, communicated uide Obj 1320809993 /2025 dated 24.02.2025 as illegal and arbitrary and contrary to the provisions of the Passports Act, 1967 and consequently direct respondent No.2 to issue passport by processing application uide file No.HY1067376a31125 dated

06.O2.2O25 without reference to the said criminal case.

It is the case of the petitioner that she has filed an application uide File No.HY1067376831t25 dated 2 --I 06-O2.2025 before respondent No.2 for issuance of passport by complying with all requisite conditions under Passports Act, 1967. Respondent No.2 while processing the application, called the petitioner on 06-02.2O25 and on enquiry, the petitioner revealed that a criminal case in Cr.No.7 of 2016 for the offences under Section l2O-B' l2l' 121(Al rlw 34 IPC, under Section 10, 13, 18' 18B and20 of UA(P) Act, Section 8(1X2) of Telangana State Public Security Act, 2012, pending for trail uide SC No.6 of 2023 on the file of Principal District and Sessions Court, Siddipet. Thereafter, petitioner was again called on 1O.O2.2O25 :rnd after examining, the passport authorities have refused passport services to the petitioner under Section 5(2)(c) of the Passports Act. The respondent authorities have also issued objections uide Object'ion letter dated 24.02.2025. Questioning the same, the present writ petition is filed

Ms.B.V.R.Rajya Lakshmi, learned counsel representing Mr.Gadi Praveen Kumar, learned Deputy Solicitor General of India submits that uide Objection letter 7 .) dated 24.O2.2025, the respondent authorities have requested for some original documents and if the same are produced by the petitioner, appropriate orders would be - passed.

4. Learned Assistant Government Pleader for Home appearing on behalf of respondent No.3 would submit that petitioner was involved in a criminal case against the State I in Cr.No.7 of 2016.

On hearing learned counsel on either side and on perusal of the record, this Court deems it appropriate to dispose of the writ petition with a direction to respondent No.2 authority to dispose of the petitioner's application and take appropriate action in accordance with law, subject to the petitioner furnishes requisite documents as per the objection letter dated 24.02.2025.It is made clear that this Court has not expressed any opinion on merits of the case'
