The case of the petitioner, in brief, is that the petitioner is involved in the transportation of coal for Singareni Collieries Company Limited - respondent No.1, and had successfully executed several contracts, receiving performance and satisfactory certificates from respondent No.1. On 24.07.2023, the petitioner was awarded a contract for deploying 8 tippers for rehandling coal at JVR OCP for three years, with a total value of Rs.7,24,32,000. However, respondent No.1 diverted the said tippers for other projects, causing operational issues and non-payment of dues to the petitioner. Despite several representations made by the petitioner, including letters dated 01.L2.2023, t3.12.2023, L4.L2.2023, and 15.12.2023, the respondent No.1 unilaterally altered the terms of the contract, reduced the project duration, and threatened penalties. Aggrieved by the same, the petitioner filed W.P.No.1214 of 2024 challenging the actions of respondent No.1 in instructing the petitioner to deploy the tippers from work and this Court, vide its order dated 30.01.2024, granted interim stay, but respondent No.1 failed to comply with the same. ) Moreover, Respondent No'1 issued a new tender (NIT EKG2300238' dated16.02.2024),whichthreatenstodisqualifythepetitionerdue to the ongoing legal matter' Aggrieved by the same' the petitioner filed the Present Writ Petition' rs Court v e_its t v t o 2 24 oass d ne ln A 1 2 24 f 24 u 4 tn n w P. It is the specific case of the petitioner that the petitioner on an earlie- occasion approached the Court by filing W.P.No.12 14 of 2024 seeking a direction against the respondents herein to utilize the hiring of vehicles for the description of work allotted as per the service order No.7500052434 dated 24.07.2023 and the said relief was granted in favour of the petitioner vide order of the Court dated 30.01.2024 in I.A.No.1 of 2024 in W.P.No.1214 of

2024. It is further the case of the petitioner that the respondents may not consider and finalise the tender dated 27.03.2024 submitted by the petitioner in response to Notice Inviting Tenders (NIT) Enquiry No.EKG23O023B dated 16.02.2024, on the ground of pendency of W.P.No.12t4 of 2024 and due to the /is in W.P.No.l2l4 of 2024. Mr.Harsha Reddy, learned counsel appearing on behalf of the 1't respondent submits that the petitioner approached the Court only under apprehension and the writ petition itself is pre rna tu re.
