This Transler Civil Miscellaneous Petition i; filed under Section 24 of thc Civil Procedure Code seekin 1 transfer of F.C.O.P.No.578 of 2020 pending on the file cl the learned Judge, Additional Family Court at Rangaredcl , District at 2 L.B.Nagar to the file of the learned Senior Civil Judge at Nalgonda, to be tried along with O.p.No. IO9 of 2O2O. 3. Learned counsel for the petitioner submitted that petitioner-wife is a resident of Narketpally, and the same is evident from the cause title in F.C.O.p No.57B of 2O2O. Further, the petitioner is living with her parents and is dependent on them for her maintenance. She filed O.p.No. 1O9 of 2O2O seeking restitution of conjugal rights and the said O.p. is currently at the stage of commencement of trial after framing of issues. Learned counsel further submittcd that transfer is necessar5r in order to avoid conflicting judgments by tu,o dilferent Courts.
4. In support of his contention, learned counsel for the petitioner relied upon the judgment of the Honble Supreme Court in N.C.V, Aishwaryd us. A.S. Sarauana Karthik Sho,l, u,herein, the petitioner-wife was residing at Vellore and the respondent-husband was residing at Chennai and considering the age, dependency of the wife a,d the distance between the '2022 SCC online SC 1199 3 places, allowed the Tr.C.M.P. in favour of the ::titioner-wife therein.
5. Learned counsel for the respondent oppose( the transfer by filing counter. Firstly, learned counsel su rmitted that F.C.O.P No. 578 of 2O2O is at the stage of cross-e::amination of RW-2, who is father of the petitioner herein. 'I he petitioner was already examined as RW- 1 and onc() the cross- examination of RW-2 is completed, the said F.C.( ).P No.578 of 2020 rvould be posted for hnal arguments, wherr:i Ls, trial is yet to be commenced in O.P.No. 109 of 2O2O lled by I re petitioner- wife. Seconclly, learned counsel submitted that - re son of the petitioner is admitted in a School at Hayatrr rgar, Khalsa Branch, and in proof thereof, photographs ar d admission receipts are produced. The said photographs at rd admission receipts shou. that the child Ramidi Anirudh Red: y is admitted in Sri Chaitanya Techno School at Hayatnagar. Lastly, the respondent pr-octuced a copy ol the complaint lo< ged with the Circle lnspector, Nalgonda 1 Town Police S 1 ation, dated
03.12.2025, u.her-ein it is stated that the petit oner herein, I I 4 after hearing the M.C. case, has broken the car glass with a stone. In view of this incident, the respondent apprehends with respect to his safety for attending the Courts at Nalgonda. 6. As seen from the record, it is noticed that the petitioner herein is aged 3l years and is a house wife, dcpending upon her parents. However, she is attending F.C.O.p.No.57B ol 2020, pending on the file of the learned Judge, Additional Family Court, Ranga Reddy District at L.B. Nagar, for the past five years and currently, the matter is at the stage o[ cross examination ol RW-2. Further, the photographs and the admission receipts show that the son of the petitioncr is living at Hayatnagar, Khalsa and attending the school for the purpose ol speech therapy. Further, in the complaint liled before the Nalgonda I Town Police Station, it is alleged that the petitioner broken the car glass with a stone, which itself shows the violent behavior of the petitioner. 7 - In view of the foregoing circumstances, since F.C.O.P.No.578 of 2O2O is at the fag end of trial, this Courr lrnds no reason to transfer F.C.O.P.No.578 of 2O2O, at this I I 5 I I juncture. The question of conflicting decisions r loes not arise when once F.C.O.P.No.578 of 2O2O is disposerl of, the same will have a bearing on the O.p. filed by the petiti: ner_wife. 8.
