I to 3 are the ptaintiffs and /respondent Nos' I .1 to 14 are the del''endant Nos.2 to 5 in O.S.No.79 of 2011 ' Respondent Nos.5 to [0 are t.he legal heirs of deceased 1't defendant/resrrondent No.4. Defer.rdant Nos.2 to 5/respondent Nos.1l to 14 are tlre legal heirs of one late satyamma, who is the sister of the plaint Lffs and defendant No. 1 .
2. I-earned counsel for the appellant has further surbmitted that the appellant has purchased the suit schedule property through the deceased 1" defendant/respondent No.4 and his legal heirs i'e' respondent Nos.ti and 9. The said suit was filed for partition and a preliminary dect'ee was passed thelein on 13-12-2012' l 2
3. Leamed counsel for the appellant has further submitted that the appellant has settled the issue with the plaintiffs/respondent Nos. I to 3 and defendant Nos.2 to 5/respondent Nos.ll to 14. lnsofar as settlement with the respondent Nos.5 to 10, though notices were sent to them, but they have not tumed up. Thereafter, the appellant has filed I.A.No.2 of 2025 to record the compromise by filing a compromise memo dated 06-02-2025.

Today the appellant/3'o pu.ty, piaintiffsirespondent Nos.l to 3 and defendant Nos.2 to 5/respondent Nos.l l to 14 are present in the Court and they were identified through their respective counsel. Smt. T. Dhanalakshmi, leamed counsel appearing for plaintiffs/respondent Nos.l to 3, has identified her parties. Therefore, leamed counsel for the appellant as well as respondent Nos.l to 3 and 1I to 14 had submitted that the present appeal may be closed in terms of compromise memo dated 06-02-2025 filed in I.A.No.2 of 2025.

In view of the above submissions, this Court is of the considered view that since the respondent Nos.5 to 10 have not appeared in spite of notices were served and therefore they were 7 3 called absent anrl set ex parte,hence, there is no other option except recording the compromise entered into between the appellant' plaintiffs/respondent Nos' 1 to3 and de'fendant Nos''2 to 5/respondent Nrls.l I to t4 in terms of compromise memo dated 06-02-2025 filed in I.A'No'2 of 2025'
