The present writ petition is filed by thr: petitioners seeking to declare the action of respondent No.3 ir refusing to 2 receive, register, and release the mortgage deed presented by the petitioners in respect of the subject properties bearing Door No.3-1 ICV ICPIV-I9 (Villa/PIot No.19), admeasuring 483.33 square yards, and Door No.3- 1/CV/CP lV-84 (Villa/Plot No.84), admeasuring 429.16 square yards, forming part of a gated community named "Cyprus Palms," situated in Survey Nos.8O and 80/A of Hafeezpet Village, Serilingampally Mandal, Ranga Reddy District, on the alieged ground that a portion of Survey Nos.8O and 8O/A of Hafeezpet Viilage has been placed in the prohibitory list pursuant to an attachment order passed by respondent Nos.4 and 5, as being illegal and arbitrarv

4. Learned Assistant Government Pleader submits that the official respondents will lollow the procedure contemplated under SectionTI of the Registration Act, 1908.

Section 71 of the Registration Act, 1908 reads as follows Reasons for refusal to register to be recorded.- (1) Every Sub-Registrar refusing to register a document, except on the ground that the property to which it 3 relates is not situated within his su r district shall make al order of refusal and recor< : I his reasons for such order in his Book No.2, anr endorse the words "registration refused" on the d::ument; and, on application made by a.ry persor oxecuting or ciaiming under the document, s I alt, without payment and unnecessary delay, give rim a copy of the reasons so recorded. i ( ) \ (2) No registering officer shall accept for .egistration a document so endorsed unless and u r.r il, under the provisions hereina_fter contained, tht. document is directed to be registered.

In vieu, of the above submissions cou; led u,ith the provision under Section Tl of the Registration ^ :t, 1908, this Writ Petition is disposed of directing the Registc ing Authority to receive and process the document sought t,r be presented by the petitioners in respect of the subject prop r .ry, subject to the petitioners complying with the prorris ons of the Registration Act, i90B as u,ell as the Indian Stzr .rp Act, 1899. It will be open to the Registering Authoritv r> refuse the registration of the document presented before I im, if he has any objection, duly assigning reasons in sup port of such decision and communicate the said dec i ;ron to the + petitioners. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioners to get the subject document registered.
