Counsel for the Petitioners: SRI P.ACHUT RAMA SHASTRY Counsel for the Respondents: Gp FOR REVENUE The Court made the following: ORDER (\ THE HON'BLE SRI JUSTICE C.V.BHASI{AR REDDY WRIT PETITION No.9 3ll of2O25 ORDER: This writ petition has been hled seeking to declare. the action of respondent Nos.2 and 3 in not isSuing and mutating the names of the petitioners as legal heirs in respect of land admeasuring Acs.6.OO in Survey Nc.196 situatcd at Maisapet Village, Yadagirigutta Mandal, Yadadri-Bhongir district as illegal and arbitrary ald for other appropriate reliefs. The petitioners claim to bc thc oivners and pcssesscl.s of land aCmeasuring Acs.6.00 in Survey No. 190 jituated at l\{aisapet Village, Yadagirigutta Mandal, yadadri-Bhongir District, having inhcrited the samc from thcir ancestors, ufiose names have been recorded in the 1-B Register prepar-ed under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, l97l (for short 'the Act 26 of l97l"l and the Rules made thereunder. The grievance of the petitioners is that even though they are in possession of the said property, despite several requests, the respondent authorities are not initiating any steps for mutating their names in the revenue records much less issuing pattadar pass books in their favour, basing on t}le entries made in the 1-B register. I l I 2 Considered the submissions of the learned counsel for the parties and perused the record. There is no dispute that the entries made in the 1-B Register are considered as record of rights. Further, it is settled law that once entries are made in the 1-B Register under the provisions of the ROR Act, 1gT I and the Rules made thereunder, a duty is cast upon the Tahsildar for issuance of pattadar pass books as per the provisions ofthe Act 26 of 1971, based on the said entries. Since it is the specihc case of the petitioners that even though the names of their ancestors have been recorded in the 1-B Register, the respondents are not mutating their names in the revenue records nor issuing pattadar books in their favour and in view of the fact that the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O (for short .,the Act 9 of 2020,,) has been repealed and replaced with Telalgana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short "the Act 1 of 2025"), this Court, without going into the merits of the matter, deems it appropriate to dispose oi ihis writ petition permitting the petitioners to make appropriate online application in the prescribed format in Bhu Bharati Web portal, seeking mutation _of their names illevenue records in respect of subject lands /./ I , I I i ! ! i I I I i I I ':,1.i -l and for issuance of pattadar passbooks. In the event of such application being made by the petitioners, duly enclosing necessary documents and if the petitioners comply with all the requirements under the provisions of the Act L of 2O2S and the Rules made thereunder, the respoitdent auihorities shall examine and consider t-he case of the petitioners. In arry cvent, if the petitioners have not satisfred with the requirements of the Act 1 of 2025 and the Rules made thereunder, the respondent i authorities sha1l pass a reasoned order, in accordalce with law and comrnunicate the same to the petitioners. The entire exercise shall be completed within a period of three (03) months from the date of receipt of the application. With the above observations, this Writ petition is disposed of. There shall be no order as to costs. Pending miscellaleous applications, if any, shall stand closed. SD/.
