23.09.2024 submitted by the petitioners seeking lor conducting survey and demarcation of the land to an extent of Ac.3-26 gunlas in Sy.Nos.96l12, 96/3, 9614, 9616 and 96/7 situated at Shampuram Village, Sangem Mandal, Warangal District, as illegal, arbitrary and violative of the Articles 14, 15, 21 and 3OO-A of the Constitution of India and for other appropriate reliefs.

It is stated that the petitioners are the pattadars and possessor of the agriculture land to an extent of Ac.3-26 guntas in Sy.Nos.96/2, 96/3,96/4, 96/6 and 9617 situated at Shampuram Village, Sangen Mandal, Warangal District and the names of the petitioners were reflected in all the revenue records as pattadars and the rcvenlle authorities also issued e-pattadar pass books in their favour. It is further stated that the petilioners have submittecl F Line application No.DER0224O IOC)7146, dated

23.09.2024 before the respondents, by paying rcquisite fee to conduct survev of the subject land and hx the borrndaries. The grievance of the petitioners is that even after receiving the said F- 2 Line application, the respondcnt authorities are not conducting survey and lxation of the boundaries.

3. Considered the submissions o[ the iearned counsel for the petitioners and learned Assistant Government Pleader for Revenue .appearing for the respondents and with their consent this writ petition is disposed of at the admission stage. Learned counsel for the petitioners has submitte d that in

4. terms of the circular issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessary charges.

5. Sri L. Ravinder, learned AssistanL Government Pleader for Revenue appearing for the respondents has submitted that the respondent authorities will consider the aforesaid F-Line application submitted by the petitioners by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries.

It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of 1317 Fasli), the Telangana Survey and Boundaries i I i I I I I I I { i i I l I 3 AcL, 7923, and the Rules framed thereunder. The Government has issued various ()irculars specifying the conditions for conducting surveys, partioularly F-Line (field measurement) surveys. Indivicluals requesting such surveys are required to submit specific documents, anc: il the conditions stipulated in the circulars are fbtfilled, the survey and boundary hxation may be conducte<l. The Commissioner, Survey, Settlements and Land Records, r:xercising powers under the Tclangana Survey and Boundarics Act, 1923, issued relevant circulars from time vide Rc.No.Nl/6543 /99, dated 25.O7.2OO1, Rc.No.N1/ 1408/07, dated

13.O7.2OO7, zLnd Rc.No.N2/1741 12O1O, datecl 18.05.2010 stipulating the conditions for conducting survey of private lands and as per the said circulars, if the petitioners fulfill all the conditions of thc said circular, it is an obligarion fcrr the 't \ respondents to conducL survey within Lhe time specificd in the said f circulars.

In view ,rf the aforesaid discussion, this Court deems it appropriate to dispose of this writ petition directing respondent Nos.S and 6 L r examine the petitioners F-Line application uicle No.DERO2240 1097146, dated 23.O9.2024 submittecl for conducting survey and demarcation by fixing boundary stones [o the petitioners lzrnd to an extent of Ac.3-26 guntas in Sy.Nos.96/2, .-\#l 96/3, 96/4, 96/6 and 9617 situated at Shampuram Village, Sangem Mandal, Warangal District, and if the petitioners fulfrll all the conditions mentioned in the circulars issued by the Commissioner, Survey, Settlements and Land Records from time to time, after issuing notices to all the persons interested and adjacent pattadars and after considering their objections, respondent Nos.5 and 6 shall conduct survey of the aJoresaid land, within a period of eight (8) weeks from the date of rcceipt of a copy of this order.

8. With thc above observations, this Writ petition is disposed of. There shall be no order as to costs.
