DEVENOAR, SC FOR CIVIL SUPPLIES Counsel for the Respondent Nos. 5&g: Gp FOR HOME The Court made the following: ORDER THE HONOURABLE SMT JUSTICE T'MADHAVI DEVI WRIT PETITION No.92OO oF 2025 oRDER: In this writ petition, the petitioner is challenging the action of the respondent authorities in not closing the case rn Crime No.42 of 2024 dated' 1 1'O4' 2024 registered against him for the offences punishable under Sections 42O and 4O9 of IPC and Section 7 of the Essential Commodities Act' 1955' 2. On an earlier occasion' the petitioner had frled W.P.No.28422 of 2024 stating that without conducting any enquiry and without there being registered agreement between him and the respondents therein' the crime could not have been registered' This Court' at the admission stage' has directed respondent No'2 - Corporation to produce the copy of the agreement before the police' within a period of one month from the date of the order and if the same is not produced, then to presume that there is no agreement between the parties and directed the police to take action accordinglY. a -1 2

Learned counsel for the petitioner has drawn the attention of this Court to the proceedings of the District Manager - respondent No.7 dated 04.1I.2024 and 31.07.2024 to the effect that no agreement is entered into by the petitioner with the Corporation. He, therefore, made his representation to the Superintendent of police _ respondent No.S on 2O.O2.2O25 to close the case against him. 4. The respondents have filed their counter afhdavits and according to the counter affidavit hled by respondent No.7, there was no written agreement, but as per G.O.Ms.No.23, dated 18.10.2022, tine CMR paddy has been procured and supplied to the petitioner a,d there is default by the petitioner in supply of the CMR rice. He further submitted that on arl earlier occasion, the petitioner has filed a criminal petition befor-e this Court for quashing of the FIR and subsequen tly has withdrawn the same after rrring of the counter affidavit by the Corporation bringing the factual aspects tct the notice of this Court. 5. Having regard to the submissions made by both the parties, 'ihis Court finds that the petitioner 1S seeking quashing of the FIR on the ground that there is no ground for i I 3 registering the case against him, as there is no agreement between the parties. The said issue will have to be considered in an appropriate application before this Court and not in this writ petition frled under erticle 226 of the Constitution of India. The petitioner is, therefore, granted liberty to frle appropriate application before the Court for quashing ofthe FIR on the above ground'
