During the pendency of the appeal, it is stated by the learned counsel for the appellant as well as contesting respondent Nos.l and 2 that both the parties have resolved the dispute amicably in an out of court settlement' Accordingly, both the appellant and contesting respondent Nos'1 and 2 have entered into a Memorandum of Understanding - Cum - Compromise Agreement dated 12.1 1.2025'

By the present application uide I'A No' 1 of 2025 frled by the appeltant along with a joint memo of terms of compromise dated 19.11.2025 filed under Order XXIII Rule'3 of the Code of Civil Procedure, 1908, prays to record the compromise between the petitioner/ appellant and the contesting parties i'e'' respondent Nos.1 and 2 herein, in terms of the said Memorandum of Understanding - Cum - Compromise Agreement dated 12. 11.2025, thereby to allow the C M'A No 174 of 2022 by setting aside the impugned interim injunction order dated 31.08.202 1.

This Court vide order dated 2 1 ' 1 l '2025 referred the matter to the High Court I-egal Services Committee to verify the authenticity of memorandum of compromise and identity of the respective parties. Accordingly, the respective parties-in-person along with their counsel appeared before the High Court I-egal Services Committee on 26'112025' The authority \ I I I 3 having verified the identity of all the parties inclt ding the proprietor of the petitioner/ appetlant namely Sri A.G.l': abhakar, with reference to the Aadhar cards of tJre respect r : parties (which are also endorsed by the respective counse ) sent its report dated 26.1),.2025 and placed the same on re(:( rd before this Court duly certifying the verification of particuLr rs of the respective parties. The authority also certihed that t re parties have willfully and without any coercion have er t :red into compromise.

In view of the settlement arrived at between t re parties and taking into consideration, verihcaLion report sut mitted by the High Court tegal Services Committee, this Cou: deems it appropriate to record the compromise entered into tx tween the petitioner/appellant and the contesting respqndent N r s. I and 2, in terms of the Memorandum of Understanding - cum - Compromise Agreement dated 12.1 1.2O25, which 'lrall form part of this judgment.

Settlement Between Parties: That, the First Party and the Second Party have amicably settled all their disputes relating to the Registered Development Agreement-cum-GPA's and construction of "HEMA RESIDENCY' in respect of Plot No.21 Part, Sy.Nos.52A & 53B, admeasuring 905 Sq.Yds.; Peerzadiguda Village, Medipally Mandal, Ir4edchal-N/alkajgiri District.

3. Recognition of Builder's Development: That, the Second Party acknowledges that the First Party under the Registered Development Agreement-cum-GPA dated: 13.12.2O19 vide Document No. 18444/2019 has completed the project and already allotted the landowners' share as per the said document. ln order to settle the civil disputes, i.e., O.S.No. 20012022 (Old O.S.No.B9 of 2021), which is pending on the file of the Hon'ble lV-Additional District Judge, Medchal-Malkajgiri District, at Malkajgiri, & C.M.A.No. 174 of 2022, which is pending before the Hon'ble High Court for the State of Telangana at Hyderabad, and above mentioned cases are pending between the First Party and Second Party and put to a quietus to the litigation, the First Party has agreed and accepted to give and afienate 5 flats in favour of Second Party as shown in the below mentioned table.

4. No Objection to Prior Sales That, the Second Party agreed and accepted that, Second Party has no objection, whatever the flats sold out by the First Party in favour of purchasers/third parties pursuant to Registered Development Agreement- cum-GPA dated 13-12-2019 already under valid sale agreements and sale deeds, except the Flat Nos. 104, 201 ,3O1,305 & 401 being allotted to the Second Party under this MOU-cum-Compromise Agreement and that it is agreed and assured that such purchasers shall continue to enjoy their flats peacefully, without any interference or claim from the Second Party.

5. Flats Agreed to be Conveyed to FIRST PARTY by the SECOND PARTY That, in consideration of the Second Party's investment, the efforts and earlier construction under Doc.No.1393/2008, the First Party agreed and accepted to transfer and register the following flats in the name of the Second Party or their nominee. Remaining Builder's Share: a) That, the Second Party agreed and accepted, more particularly acknowledging that, after alienation or conveyances in respect of flats shown in the table mentioned above in favour of Second Party, and remaining flats falling to the share of the First Party namely Flat Nos. 204, 2O5,302,4O2,4O3,405, 406, 501, 505, and 506 and all these flats shall be freely alienable & saleable by the First Party to an intending or prospective purchasers, without any objection from the Second Party, however subject to registration of flats allotted to the Second Party by the First Party. b) That, the First Party herein agreed and accepted that, First Party not having any right or authority to sell or alienate the Flat No. 204, in favour of any third party, until First Party completed the pending works in respect of Flat No's. 301, 305, 401, which are fallen in favour of Second Party herein, pursuant to this MOU-cum-Compromise.

9. Waiver and No Further Claims: That, the Second Pa(y hereby waives all past and future claims, rights, title, or interest in respect of the said project or land except the flats allotted under this compromise and shown in the table mentioned above.

10. No Claim by Landlords or Legal Heirs: a) That, First Party hereby declare that, the land-owner and legal heirs of land-owner, i.e., Late Smt. M. Hemalatha already got & received the their respective flats and shares from the First Party in pursuant to registered Developmental Agreement-cum-GPA vide documdnt No. 18444/2019, daled:13.12.2019 registered in the office of SRO, Uppal. Therefore, land- owner or legal heirs of the land-owners neither having any right over the builder share, nor the flats allotted to the Second Party which are fallen to the share of First Party in the registered Developmental Agreement-cum- GPA vide document No. 18444/2019, dated:13.12.2019. Hence, the First Party and Second Party have entered into this compromise through the present Mou. b) That, First Pa(y hereby clarified through this MOU-cum-compromise Agreement that, pursuant to Registered Developmental Agreement-cum- GPA, dated: 1393/2008, dated: 08.02.2008, the land-owners have entered into the said Registered Development Agreement-cum-GPA dated 08-02- 2008 originally with 5 partners, i.e., 1) Mr.P. Prabhakar,2) D. Nandishwar Goud, 3) V.Jaipal Reddy, 4) P.Shankar, & 5) V. Raju, out of the said 5 partners, 3 partners, 1) Mr.P. Prabhakar, 2) V.Jaipal Reddy, 3) P.Shankar have already settled their claims with the First Party out of the court, and 1) Mr.P. Prabhakar, 2) V.Jaipal Reddy, 3) P.Shankar also acknowledged the said settlement.
